RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME
CONSENTING TO THE WITHDRAWAL OF THE BID SUBMITTED BY
BAY PACIFIC PIPELINE, INC. AND AWARDING CONTRACT TO
KIMKAN CONSTRUCTION, INC. FOR THE
SANCHEZ AVENUE WATER MAIN REPLACEMENT
CITY PROJECT NO. 9505-1
RESOLVED, by the City Council of the City of Burlingame, California:
WHEREAS, the City Council has authorized an invitation for bids for the SANCHEZ
AVENUE WATER MAIN REPLACEMENT, CITY PROJECT NO. 9505-1; and
WHEREAS, on MAY 26, 1998, all bids were received and opened before the City Clerk
and representatives of the Public Works Department; and
WHEREAS, the apparent low bidder was Bay Pacific Pipeline, Inc.; and
WHEREAS, on May 29, 1998, Bay Pacific Pipeline notified the City that it had made a
mistake in computing the bid that was submitted in that the cost of materials for certain of the
piping systems had been omitted by mistake from the calculation and filling out of the bid
amounts, which resulted in a material difference of many thousands of dollars; and
WHEREAS, Bay Pacific provided its calculation sheets to the City demonstrating its
mistake and asked that it be allowed to withdraw its bid; and
WHEREAS, pursuant to Public Contracts Code section 5 10 1, it is in the public interest
to allow Bay Pacific to withdraw its bid and there is no evidence of collusion or fraud; and
WHEREAS, KIMKAN CONSTRUCTION, INC. was the second apparent low bidder for
the project in the amount of $259,087; and
WHEREAS, KHVEKAN CONSTRUCTION did not submit an acknowledgment of receipt
of Addendum No. 1, which deleted or amended three minor technical matters that have no effect
on the bid price or calculation, with its bid, because it did not receive the Addendum before the
bid was submitted; and
WHEREAS, KIMKAN has now executed the acknowledgment; and
WHEREAS, it is in the public interest to waive this minor irregularity in the bid
submittal,

NOW, THEREFORE, be it RESOLVED, and it is hereby ORDERED, that:
1. The Plans and Specifications, including all addenda, for Project 9505-1 are
approved and adopted; and
2. The request of Bay Pacific Pipeline, Inc. to withdraw its bid due to a mistake in
filling out the bid is approved.
3. The minor irregularity in the bid submitted by KimKan Construction, Inc. of not
submitting acknowledgment of Addendum No. 1 is waived.
4. The bid of KimKan Construction, Inc. for Project 9505-1 in the amount of
$259,087 is accepted.
5. The City Manager is hereby authorized and directed to execute the contract for
Project 9505-1 for and on behalf of the City with KimKan ConstructiovAc. for the performance
of the work
