RESOLUTION APPROVING CATEGORICAL EXEMPTION and SPECIAL PERMITS
RESOLVED by the CITY COUNCIL of the City of Burlingame that:
WHEREAS, a categorical exemption has been proposed and application has been made for
snecial permits to allow an accessory slructme in excess of 600 SF and windows and skylights
higher than 10'-0" above grade and skylights within 10'-0" of the rear and right side property lines
at 721 Walnut Avenue zoned R-1 APN: 028-142-050- Michael J. and Christine L. Read

WHEREAS, the Planning Commission held a public bearing on said application on Mav
26. 1998 , at which time said application was denied; H

WHEREAS, this matter was apoealed to City Council and a hearing thereon held on June &,n
IQ,1998 , at which time it reviewed and considered the staff report and all outer written materials
and testimony presented at said hearing; U.
NOW, THEREFORE, it is hereby RESOLVED and DETERMINED by this Council that:
1. On the basis of the Initial Study and the documents submitted and reviewed, and comments
received and addressed by this commission, it is hereby found that there is no substantial evidence
that the project set forth above will have a significant effect on the environment, and a Categorical
Exemption per Article 19, Section: 15303 - Class 3 - New Construction or the Conversion of
Small Structure including (e) accessory (appurtenant) structures including garages, carports, patios,
swimming pools and fences is hereby approved.
2. Said special permits are approved, subject to the conditions set forth in Exhibit "A"
attached hereto. Findings for such special permits are as set forth in the minutes and recording of
said meeting.
3. It is further directed that a certified copy of this resolution4recorin the d/records of the County of San Mateo.

Conditions of approval categorical exemption and special permits
721 WALNUT AVENUE
effective JUNE 1, 1998
1. that the project shall be built as shown on the revised plans submitted to the Planning
Department date stamped May 14, 1998, (site plan, east elevation, west elevation, floor
plan, south and north elevation);
2. that the conditions of the Chief Building Official and Senior Engineer's May 4, 1998
memos shall be met;
3. that use of the structure shall be limited to off-street parking for vehicles, and that the
accessory structure shall never be used, rented, or converted into a second dwelling unit;
and that there shall be no sewer or water services connected to the accessory structure;
4. that the 13" oak tree that must be removed shall be replaced, before the building permit
is finaled, with a substantial tree (i.e., 24" box), which will screen the neighbor adjacent
to the side property line nearest the new garage; and
5. that the project shall meet all the requirements of the California Building and Fire Codes,
1995 edition, as amended by the City of Burlingame.
