RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME
AFFIRMING A DECISION OF THE PLANNING COMMISSION TO DENY A
HILLSIDE AREA CONSTRUCTION PERMIT FOR A NEW HOUSE AT 1523 LOS
ALTOS DRIVE AND DENYING THE APPEAL
ZONE R-1
PROPERTY OWNERS AND APPLICANTS: I PING AND JANETTE SU HO

RESOLVED by the CITY COUNCIL of the CITY of BURLINGAME that:
WHEREAS, this matter came before the City Council for public hearing on May 18, 1998,
on appeal from the decision of the Planning Commission denying a hillside area construction permit,
and was regularly noticed in accordance with State and City law; and
WHEREAS, the Council received and considered all written documentation and oral
testimony submitted from all interested persons; and
WHEREAS, the Council visited the neighborhood and observed the story poles erected by
the applicants before the hearing; and
WHEREAS, distant views from Burlingame properties are extremely valuable; and
WHEREAS, views of the hills and mountains around the City are as significant as those of
San Francisco Bay; and
WHEREAS, the evidence shows that significant views would be lost or substantially lost to
a number of homes in the neighborhood if the home design proposed by the applicants were built; and
WHEREAS, it appears that a two-story home could be designed for the applicants' property
that would minimize its impact on the views from other properties; and
WHEREAS, the applicants' home would be located on the apparent apex of the
neighborhood hill and would have a disproportionate impact on the views of other properties because
of its location; and
WHEREAS, the two-story additions on the east side of Los Altos have been constructed so
that they generally appear as single -story homes from the street and do not affect Bay views from the
west side of Los Altos Drive,
WHEREAS, the view blockages that might be caused by this project are the type of
blockages for which the hillside area construction permit process was developed,
NOW, THEREFORE, it is hereby ordered and directed as follows:
1. The decision of the Planning Commission is affirmed, and the application for a hillside area
construction permit submitted by applicants is denied.
This decision is a final administrative decision of the City of Burlingame. Anyone wishing to
challenge this decision in a court of competent jurisdiction must do so within 90 days ant to
Code of Civil Procedure Section 1094.6 unless a shorter
