RESOLUTION NO. 45-98
RESOLUTION APPROVING CATEGORICAL EXEMPTION,
VARIANCES AND SPECIAL PERMITS
RESOLVED by the CITY COUNCIL of the City of Burlingame that:
WHEREAS, a Categorical Exemption has been proposed and application has been made for

WHEREAS, the Planning Commission held a public hearing on said application on April 27.
1998 , at which time said application was approved;
WHEREAS, this matter was appealed to City Council and a hearing thereon held on May
18. 1998 , at which time it reviewed and considered the staff report and all other written materials and
testimony presented at said hearing;
NOW, THEREFORE, it is hereby RESOLVED and DETERMINED by this Council that:
I. On the basis of the Initial Study and the documents submitted and reviewed, and comments
received and addressed by this commission, it is hereby found that there is no substantial evidence that
the project set forth above will have a significant effect on the environment, and a categorical
exemption per Article 19, per CEQA Section 15303, construction and location of limited numbers of
new, small facilities or structures including (a) single-family residences not in conjunction with the
building of two or more such units is hereby approved.
2. Said Variances and Special Permits are approved, subject to the conditions set forth in Exhibit
"A" attached hereto. Findings for such variances and special permits are as set forth in the staff
report, minutes and recording of said meeting.
3. It is further directed that a certified copy of this resolution be recorded n the official recolds
of the County of San Mateo. —

foregoing resolution was introduced at a regular meeting of the City Council held on the 18th day
of May , 1998 , and adopted thereafter by the following vote:

effective MAY 18, 1997
1. that the project shall be built as shown on the plans submitted to the Planning Department date
stamped March 4, 1998, sheets 1 through 5, with a toilet and sink in the garage, no shower or
bathtub shall be allowed;
2. that the left side property line shall be surveyed to verify the existing first floor setback;
3. that a portion of the accessory structure shall be used as a workroom/recreation room but shall
never be used for accessory living or sleeping purposes, shall never include a kitchen or sleeping
area and shall not be used for any home occupation as defined by C.S. 25.68.010 without an
amendment to this special permit; and
4. that the project shall meet all the requirements of the California Building and Fire Codes, 1995
edition, as amended by the City of Burlingame.
