RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME
APPROVING TENTATIVE AND FINAL MAP FOR LOT COMBINATION —
1705 MURCHISON DRIVE AND 1845 MAGNOLIA AVENUE —
PARCEL A AND PORTION OF BLOCK 7, MILLS ESTATE NO. 3 — P.M. 98-6
(APN's 025-121- AND 025-121-240)
RESOLVED by the CITY COUNCIL of the CITY of BURLINGAME that:
WHEREAS, this matter came before the City Council on April 6, 1998, on recommendation
of the Planning Commission for approval; and
WHEREAS, on July 28, 1997, the Planning Commission approved a negative declaration for
a project at 1705 Murchison Drive, which involved the demolition of two existing buildings and
construction of an office building with a ten -foot variance for height, which would be approximately
11 feet lower than one of the existing buildings; and
WHEREAS, no appeal to the Council or challenge to the determination was made as required
by the California Environmental Quality Act (CEQA) or the Government Code; and
WHEREAS, the project applicant has now applied for approval of a combination of two
parcels that have been owned by the applicant for an extended period of time into one pursuant to
the Subdivision Code of the City, as required for the construction of the project approved in July
1997 so that a single structure does not cross a property line, and to place the required parking on
the same parcel as the central building; and
WHEREAS, the City Engineer, and after public hearing, the City Planning Commission has
recommended approval of the lot combination; and
WHEREAS, the Council has received and considered all written documentation and oral
testimony submitted from all interested persons, including the July 1997 negative declaration, the
permit requirements of the Bay Area Air Quality Management District, and the Notice of
Determination on the negative declaration as filed and posted by the County Clerk on August 28,
1997, for thirty (30) days; and
WHEREAS, a lot combination is categorically exempt under CEQA Regulation 15305(a)
and 15315; and
This decision is a final administrative decision of the City of Burlingame. Anyone wishing to
challenge this decision in a court of competent jurisdiction musjido so
provided by State or Federal law.
