RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF BURLINGAME CONSENTING TO WITHDRAWAL OF BID OF
BECI ELECTRIC, INC. PURSUANT TO
PUBLIC CONTRACTS CODE §§ 5101 AND 5103 AND AWARDING CONTRACT FOR
BAYSIDE PARK FIELD LIGHTING TO MIKE BROWN ELECTRIC CO. —
CITY PROJECT NO. 9721
WHEREAS, the City of Burlingame is ready to begin installation of improved lighting of the
athletic field at Bayside Park; and
WHEREAS, the City released a Notice Inviting Bids in conformance with the State Public
Contracts Code and City procedures; and
WHEREAS, sealed bids were submitted and opened on March 9, 1998, at 2:00 p.m.; and
WHEREAS, within five (5) days of the opening of the sealed bids, the apparent low bidder,
BECI Electric, Inc. gave the City written notice that its bid contained a significant mistake in entry
of items on the bid form, which amounted to over $20,000, and asked that it be allowed to withdraw
its bid; and
WHEREAS, pursuant to Public Contracts Code §§ 5101 and 5103, the City Council may
consent to withdrawal of such a bid, and there is no evidence of any collusion or misconduct involved
in the bidding; and
WHEREAS, exacting a penalty or requiring the contractor to enter into a contract under such
a circumstance seems unfair, and
WHEREAS, the second lowest bid submitted by Mike Brown Electric Co. is reasonable and
fair, and the second lowest bidder is apparently qualified and responsible to do the work; and
WHEREAS, the alternate method of pile -driving would save the City a good deal of money
on the Project,
NOW, THEREFORE, the City Council of the City of Burlingame does hereby resolve,
determine, and find as follows:
Consent is granted pursuant to Public Contracts Code §§ 5101 and 5103 to BECI
Electric, Inc. to withdraw its bid on Project No. 9721. BECI Electric, Inc. is disqualified pursuant
to Public Contracts Code § 5105 from further participation in bidding on this project.
2. All bonds and security received in connection with the bid by BECI Electric, Inc. shall
be returned to BECI Electric, Inc.
3. The contract for Project No. 9721 is awarded to Mike Brown Electric Co.
4. The City Manager is authorized and directed to execute an agreement for and on
behalf of the City with Mike Brown Electric Co. pursuant to the Plans and Specifications, Notice
Requesting Bids, and the bid submitted by Mike Brown Electric Co. for Project No. 9721 with the
alternate method of pile -driving, and the City Clerk is requested to attest to the signature of the City
Manager on the agreement.
I, JUDITH A. MALFATTI, City Clerk of the City of Burlingame do hereby certify that the
foregoing Resolution was introduced at a regular meeting of the City Council on the 6th day of APR I L
1998, and was adopted thereafter by the following vote:
