HomeMy WebLinkAboutReso - CC - 004-1998RESOLUTION NO. 4-98 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME EXTENDING THE CABLE TELEVISION FRANCHISE CURRENTLY HELD BY TCI CABLEVISION FOR SEVEN (7) MONTHS TO AUGUST 31, 1998 RESOLVED, by the City Council of the City of Burlingame: WHEREAS, on June 15, 1981, the City of Burlingame granted a franchise to Pacific Cable Television for the providing of cable television services, which franchise was to terminate on June 24, 1996; and WHEREAS, on May 20, 1996, the City Council approved a one-year extension of the franchise to June 24, 1997, in order to allow Pacific Cable to complete its transfer of the franchise to TCI Cablevision; and WHEREAS, on June 2, 1997, the City Council adopted a resolution extending the franchise for seven (7) months to January 31, 1998, to allow the franchise transfer to occur and to conduct negotiations on a renewal of the franchise, and the transfer of the franchise to TCI CableVision did occur in June 1997, and WHEREAS, TCI CableVision has requested a further extension of the franchise in order to negotiate renewal of the franchise; and WHEREAS, on January 5, 1998, the City Council adopted a resolution declaring its intention to consider extension of the franchise for seven (7) more months to August 31, 1998, and advertising a public hearing for January 20, 1998, to consider that extension, and WHEREAS, the City Clerk published a notice of the proposed extension and the public hearing in a newspaper of general circulation in the City, and 1 WHEREAS, on January 20, 1998, the City Council held a public hearing on the proposed hearing, and received and considered all written and oral testimony and documents submitted to the Council on the extension; and WHEREAS, TCI CableVision has had to analyze the current plant and needs of the Burlingame cable system, and was only able in December, 1997, to determine what its franchise encompassed in the City and to begin negotiations; and WHEREAS, under the rules and regulations of the Federal Communications Commission it is necessary for the City and TCl CableVision to negotiate the terms of renewal of said franchise; and WHEREAS, it is necessary for the City to adopt a new telecommunications ordinance to incorporate applicable Federal law and recognize changes in the telecommunications industry; and WHEREAS, an extension to August 31, 1998, would allow these negotiations to occur, public hearings to be held, and necessary ordinances to be adopted, and would be in the best interests of the City and the public, NOW, THEREFORE BE IT RESOLVED, the City Council ofthe City ofBurlingame does hereby resolve, determine, and find as follows: 1. The cable television franchise currently held by TCI CableVision be extended to August 31, 1998, for the sole purposes of negotiating the terms of renewal of the franchise, adopting a revised telecommunications ordinance, and making a determination on the sed renewal. ayor 2 1, Judith A.
