DISCUSSION: On May 22, 2006, the City Council held a public hearing on the proposed assessments for 2006-07 for the Burlingame Avenue Area Business Improvement District. At the close of the public hearing, the Council directed staff to tabulate the protests and report the results back to the Council. The City Clerk has tabulated the protests received and compared the protest signatures to the business license records. The Resolution of Intention requires that the person signing the protest must be shown as an owner in City records or the protest must include written evidence that the person is the owner of the business. If the business is a corporation, the City Clerk has accepted the signature of certain corporate officers as listed in California Corporation Code §313. Of the 477 business licenses listed in the Burlingame Avenue area, the City Clerk received 337 protests to the 2006-07 BID. Of these, five were not counted because they did not match the owner in City records (see tabulation attached); one was for a business previously closed, and 22 were for unlisted businesses. Of the 22, 15 protests were signed by salon employees who were already represented by each of their salons. The other seven protests are listed on the attached. Three rescissions were received negating two of the protests. The third rescission was not signed by the protestor; therefore, it was not counted. The total valuation of the BID would be $133,450 for 2006-07. The validated protests weighed in at 60.70% of the total valuation. The Council should review this report and then determine whether a majority protest has been received. Please send it as soon as you can. Our phone is ringing off the hook, we are talking and meeting with parking permit holders and people have questions and we need the list. Thanks. Also, I have question for Larry. How do you know that the protest signatures are valid signatures? Wouldn't you have to compare the original signature on the business license app in order to really know for sure? Or wouldn't you have to confirm via phone or notarized signature that these are in fact the signatures of the correct person? Do to the fact that Quent had all the protests returned to him personally and not directly to the city, makes us suspicious. We need assurance that these signatures are valid . We are not willing to allow this protest without concrete evidence. We did that last year. I don't know what our legal options are yet but I don't think we are going to take this as peacefully as last year unless we are 5/31/2006 Page 2 of 2 satisfied that signatures are valid. Anderson, City Attorney SUBJECT: CONSIDER ADOPTION OF ASSESSMENTS FOR 2006-2007 IN THE BURLINGAME AVENUE AREA BUSINESS IMPROVEMENT DISTRICT RECOMMENDATION Receive report from the City Clerk regarding protests to the imposition of assessments for 2006-2007 in the Avenue Area Business Improvement District, and determine if a majority protest has occurred. DISCUSSION On May 22, 2006,the City Council held a public hearing on the proposed assessments for 2006-2007 in the Burlingame Avenue Area Business Improvement District assessment. At the close of the hearing, the Council directed staff to tabulate the protests and report the results back to the Council. The City received protests as reported in the accompanying staff report from the City Clerk. The protests received appear to be more than fifty(50) percent of the assessed value. Therefore, the Council should determine if a majority protest has occurred, and if so, discontinue any further consideration of assessments for 2006-2007. RESOLUTION NO. RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BURLINGAME ESTABLISHING 2006-2007 ASSESSMENTS FOR THE BURLINGAME AVENUE AREA BUSINESS IMPROVEMENT DISTRICT WHEREAS,pursuant to California Streets and Highways Code Section 36500 et seg.,the Burlingame Avenue Area Business Improvement District has been established for the purpose of promoting economic revitalization and physical maintenance of this important business district;and WHEREAS,the Burlingame Avenue Area Business Improvement District Advisory Board has requested the Burlingame City Council to establish 2006-2007 assessments for the improvement district; and WHEREAS,on April 3,2006,the City Council received and approved the annual report of the Burlingame Avenue Area Business Improvement District Advisory Board; and WHEREAS, a public hearing on the proposed assessments was duly noticed for April 17, 2006, at 7:00 p.m. before the City Council of the City of Burlingame, at the Council Chambers at 501 Primrose Road, Burlingame, as required by State law; and WHEREAS,at the public hearing held at that place and time,the City Council received and considered all oral and written testimony from all interested persons, and introduced an ordinance to rebalance the assessments in accordance with the request of the Advisory Board; and WHEREAS, a public hearing on the proposed assessments was also duly noticed for May 22,2006, at 6:00 p.m. before the City Council of the City of Burlingame,at the Council Chambers at 501 Primrose Road, Burlingame, as required by State law; and 1 WHEREAS,at the public hearing held at that place and time,the City Council received and considered all oral and written testimony from all interested persons, and adopted an ordinance to rebalance the assessments in accordance with the request of the Advisory Board; and WHEREAS, it appears that assessments should be imposed so that improvements and programs may continue in the District, and the activities and improvements are without substantial change from those previously established for the District; and WHEREAS, the assessment levels proposed and to be imposed fairly balance the benefits to the various businesses in the District and are relatively similar to the assessment bases advocated by all the merchants in the District, such as the Greater North Michigan Avenue Association, NOW,THEREFORE,the City of Burlingame does hereby resolve,determine,and find as follows: 1. Written protests to assessments, improvements or activities were not received at or before the public hearing that constituted a majority as defined in Government Code sections 36500 and following. 2. The City Council does hereby levy an assessment for the 2006-2007 fiscal year on businesses in the District as described in City of Burlingame Ordinance No. 1735, to pay for improvements and activities of the District. 3. DISCUSSION On May 22, 2006, the City Council held a public hearing on the proposed amendments to the Burlingame Avenue Area Business Improvement District assessment. At the close of the hearing, the Council directed staff to tabulate the protests and report the results back to the Council. The City received protests as reported in the accompanying staff report from the City Clerk. While the protests were not clearly directly at the ordinance changes, the protests were directed at the implementation of those proposed changes. Therefore,the City Council may wish to defer any further consideration of this ordinance while the entire issue of providing a merchant organization in the Burlingame Avenue area is discussed and reworked in light of the protests to the assessments. The facility advised that the "nurse"was taking care of it. Ombudsman assumed that a home health muse was visiting. The following week ombudsman noticed the rash was considerably worse and there was now a dressing on one arm, The wife who was visiting her husband who was in bed raised the blankets to reveal a t-shirt laid over his tarso, showing patches offresh blood On questioning, the facility clarified that the 'nurse"attending to the rash was actually the administrator ofthe assisted living home. Ombudsman suggested facility make an appointment with the physician, which they duly did. At the time ofthe doctor's appointment, the physician advised the wife her husband's condition was "something old people often get,, No diagnosis was given to the wife and no treatment recommended Over the next jew wee kr the condition continued to deteriorate. A'-shirt was still carefrdly placed over the torso, but the torso now looked like raw hamburger meet, and linens were soiled with blood stains. Ombudsmen became insistent that resident betaken to a dermatologist, which did not actually happen jor several more days and after marry phone calls from the Ombudsman. The dermatologisr diagnosed Penphigus, a rare, non-contagious condition which can be fatal, etiology unknown. A home health nurse was sent to take care of the daily dressings and monitor the resident who was now on a prescribed course ofantibiotics. In Burlingame there are 14 assisted living facilities with 248 beds and 3 nursing homes with a total of 418 beds; In November 2005 OSSMC contracted with the county to provide coverage to Adult Residential Facilities for the developmentally disabled. There are 6 such facilities in City of Burlingame plus 5 adult day programs licensed for 420 clients. BACKGROUND: The San Mateo Union High School District approached the City with a request to assist with the funding of a new synthetic grass field at the Burlingame High School back field. The field will benefit the community by allowing for year-round use by a host of activities including community soccer leagues, lacrosse programs and recreational sports camps. Parks & Recreation Department staff will be responsible for the scheduling of the new field, in accord with the current practice of the City scheduling existing BHS athletic facilities. The total project is estimated at $1 . 15 million, with the District able to finance $850,000 at the current time. Of the $300,000 needed to complete the funding for this project, staff has received pledges from Burlingame Community groups for $155,000 over the next few years. These pledges are from: BHS' Athletic Boosters: $5,000/year for the next 10 years Coyotes Lacrosse: $50,000 ($40,000 initial payment; remainder within 3 years) Burlingame's CYSA: $25,000 ($10,000 initial payment; remainder within 5 years) Burlingame AYSO: $20,000 ($4,000/year for 5 years) Adult Soccer: $10,000 ($2,000/year for 5 years) This assistance would then necessitate the City contributing $145,000 to the project. However, because this field will result in maintenance savings over a natural grass field, the District will be able to repay the City its share of the costs over the next 10 years. The City funds would be taken from an undesignated reserve account, with the credit from the District supplanting funds designated for Parks & Recreation Department CIP funds for the next 10 years. If Council chooses to go forward with the project at this time, staff would create an Agreement between the City and District that would be ready for approval at an upcoming Council meeting. Similar to the Agreements for the City's participation in the Football Field and Aquatic Center projects, the City will also be granted use and scheduling rights to the High School's athletic facilities for the upcoming years.
