Anderson, City Attorney RE : Eligibility to Participate in Business Improvement District (BID) Assessment Proceedings INTRODUCTION One of the concerns expressed during assessment proceedings is whether a new or closing business is eligible to participate in the proceedings. Under general assessment and voting rights law,the City is obligated to facilitate participation without undue restrictions. DISCUSSION Streets&Highways Code§36525 specifies that owners of businesses in the proposed area which will pay 50 percent or more of the assessments eligible to participate—not businesses that have paid an assessment or that are then in existence when the proceedings are conducted or at some other point. It has been suggested that the City should cut off participation at some date, such as the time of mailing the resolution of intention or a week before the final hearing. However, nothing in the governing statutes intimates that such a process would be acceptable. A 45-day cutoff period would probably be unconstitutional. See Burns vs. Fortson(1973)410 U.S.686. Indeed,any cutoff period before the day of the hearing would have to be justified on a strong — if not compelling —public interest making such a cutoff necessary. Because the governing statutes (§ 36524)' and the City process provide a ready means for verification of whether a business is open(or closed)and thereby `(c) Each written protest shall contain a description of the business in which the person subscribing the protest is interested sufficient to identify the business and, if a person subscribing is not shown on the official records of the city as the owner of the business, the protest shall contain or be accompanied by written evidence that the person subscribing is the owner of the business. A written protest which does not comply with this section shall not be counted in determining a majority protest." Even in the most extreme circumstance, a provisional "protest"would probably work fine. In past assessment proceedings,the City has always accommodated participation until the day of the hearing. In fact,during last year's Burlingame Avenue Area BID proceedings,protests by a number of new businesses that had not yet purchased a business license were honored by both staff and the Council, because it was apparent that those businesses would be subject to the upcoming proposed assessment. Therefore, it is recommended that the City Council continue to make the BID proceedings as inclusionary as possible to be as fair as possible to all those involved and who may be subject to an assessment. 'Too often participation is viewed only as the ability to protest; however, participation also means support or neutrality in the proceedings. BACKGROUND: The Burlingame Avenue Area Business Improvement District Advisory Board presented its annual report to the Council on March 20, 2006. The report highlighted the activities of the district and provided a financial accounting of its funds. As part of the report, the advisory board asked Council to approve a new assessment fee structure that balances the assessments for district businesses. On April 3, 2006, the City Council adopted a resolution of intention to set the 2006-2007 Burlingame Avenue Area Business Improvement District assessments and designated May 22°a as the public hearing date. No changes are proposed in the boundaries or business classifications of the district. A change in the assessments was recommended by the BAABID Advisory Board. On April 17, 2006, the Council held a public meeting to receive public comment on the proposed changes in assessments. The Council then introduced an ordinance amending Chapter 6.54 of the Burlingame Municipal Code to balance the assessment basis for the district. If there is a protest by a majority of the value of the assessments to any of these items, the resolution cannot be approved. At the time of writing this memorandum, the City Clerk had received a half dozen protests. Protests may be presented in writing up to the date and time set for the public hearing. The City Clerk will calculate whether there are enough protests to prevent the assessment of fees at the end of the public hearing. BUDGET IMPACT: Approximately$137,000 in assessments is collected annually with our business licenses. All of these funds are forwarded to the Downtown Burlingame Improvement District for improvements as authorized the BID Board of Directors. Written protests to assessments, improvements or activities were not received at or before the public hearing that constituted a majority as defined in Government Code sections 36500 and following. 2. The City Council does hereby levy an assessment for the 2006-2007 fiscal year on businesses in the District as described in City of Burlingame Ordinance No. 1735, to pay for improvements and activities of the District. 3. BACKGROUND: The Burlingame Avenue Area Business Improvement District Advisory Board presented its annual report to the Council on March 20, 2006. As part of the report, the advisory board requested that Council approve a new assessment fee structure that balances the assessments for district businesses. On April 17, 2006, the Council held a public meeting to receive public comment on the proposed changes in assessments. The Council then introduced an ordinance amending Chapter 6.54 of the Burlingame Municipal Code to balance the assessment basis for the district. Adoption on the ordinance will implement the new assessment basis. BUDGET IMPACT: Approximately$137,000 in assessments is collected annually with our business licenses. All of these funds are forwarded to the Downtown Burlingame Improvement District for improvements as authorized the BID Board of Directors. ATTACHMENTS: 1.) Beautification, Maintenance and Safety: $100,000 Marketing and Promotions: $100,000 Operations: $25,000 The overall Santa Rosa Main Street budget is comprised of three revenue streams: a contract service agreement with the City of Santa Rosa, various fundraising activities to support ongoing SRMS efforts, and the annual BIA revenue. Frequently Asked Questions What's the BIA benefit to Professional Services & non-retail businesses ? While the retail businesses receive more direct benefits from this program, all businesses in the area will benefit. What's the difference BIA assessment fees versus the City Business License Fee? Business license fees go into the City's general fund to be used throughout the city as needed. BIA assessment fees can only be used within the BIA boundaries to implement programs and activities as designated and approved by the Downtown business owners. What's the duration of a BIA? The defined life of a BIA is one year and requires City Council action for renewal. How do I get involved in shaping/creating the workplan?
