HomeMy WebLinkAboutOrd 1403ORDINANCE No. 1403 ORDINANCE ADDING DEFINITIONS AND MAKING TECHNICAL AND PROCEDURAL AMENDMENTS CONCERNING ZONING The CITY COUNCIL of the CITY OF BURLINGAME does hereby ordain as follows: Section 1. Section 25.08.185 is added to the Burlingame Municipal Code to read as follows: "25.08.185 Class. A CLASS is a group of three or more persons meeting regularly for study, instruction, discussion, counseling or similar activity." Section 2. Section 25.08.064 is added to said code to read as follows: "25.08.264 Financial institution. A FINANCIAL INSTITUTION is a bank, savings and loan association, loan company, credit union, credit agency, investment company, investment counselor or manager, broker or dealer in stocks, bonds or commodities, or similar business. An automatic teller machine or any other similar banking or financial service installed or established independently from a financial institution shall be considered a financial institution." Section 3. Section 25.08.475 is added to said code to read as follows: "25.08.475 Health service. A HEALTH SERVICE is an office, clinic, laboratory, or any other facility engaged in furnishing medical, surgical or other services including a physician, dentist, dental technician, chiropractor, acupressurist, acupuncturist, therapist, counselor or other similar occupation." it Section 4. Section 25.08.495 is added to said code to read as follows: "25.08.495 Office. An OFFICE is a room or group of rooms used for conducting the affairs of a business, profession, service, industry or government; unless specifically excluded it shall include financial institutions, health services and real estate offices." Section 5, Section 25.08.555 is added to said code to read as follows: "25.08.555 Real estate. REAL ESTATE is the occupation of real estate broker or agent, title insurance, real estate investment, real estate management, real estate developer or similar business." Section 6. Section 25.04.070 of said code is hereby amended to read as follows: "25.04.070 Uses limited to those permitted. Except as authorized in this title, no premises may be used, occupied or maintained, and no building or improvement or premises shall be, or shall be permitted to be, designed, arranged, intended, used, occupied, constructed, established, maintained, altered or enlarged for any purpose other than for the uses permitted by this title in the district in which it is located. Uses not listed as permitted or conditional shall be prohibited. Specification of prohibited uses in any district shall be for illustration, example or emphasis only, and shall not be interpreted or understood as allowing uses neither permitted or expressly prohibited." Section 7. Section 25.36.020 (13) of said code is amended to read as follows: 11(13) Offices except health services, financial institutions and real estate." Section 8, Section 25.36.020 (15) of said code is hereby repealed. Section 9. Section 25.36.030 (7) of said code is amended to read as follows: "(7) Financial institutions." Section 10. Section 25.36.030 (14) is added to said code to read as follows: It (14) Real estate." Section 25.36.032-1 (e) of said code Section 11. Section 25.36.031 (1)(c) of said code is amended to read as follows: "(e) Real estate and financial institutions above the first "(1)(c) Above the first floor only: hotels; offices except real estate; financial institutions. (c) of It Section 12. Section 25.36.031-2 to read as (d) of said code is amended to read as follows: 3 "(d) Offices except health service, and except as provided in Section 25.36.32-2(e).' Section 13 Section 25.36.032-1 (e) of said code is amended to read as follows: "(e) Real estate and financial institutions above the first floor only." Section 14, Section 25.36.032-2 (c) of said code is amended to read as follows: "(c) Health services." 3 Section 15. Section 25.36.032-2 (e) of said code is amended to read as follows: "(e) Real estate, or financial institutions with frontage on Chapin Avenue, Primrose Road, Donnelly Avenue, or the west side of Lorton north of Donnelly Avenue . Section 16. Section 25.36.034 of said code is amended to read as follows: "25.36.034 Prohibited uses in Broadway Commercial area. The following uses are prohibited in the Broadway commercial area: (1) Financial Institutions. (2) Health service and real estate. (3) All other offices on the first floor." Section 17, Section 25.36.040-3 of said code is repealed. Section 18. Section 25.38.040 of said code is repealed. Section 19. Section 25.40.020 of said code is amended to read as follows: "25.40.020 - Permitted uses. The following uses are permitted in the C-3 districts: (1) Financial institutions except on lots fronting Ogden Drive and Marco Polo Way. (2) Other cffices.�- Section 20. Section 25.40.050 of said code is repealed. Section 21. Section 25.41.020 (f) is amended and Section 25.41.020 (g) added to read as follows: "(f) Office uses, except health services, in structures with a use permit pursuant to Section 25.41.025 a) or in structures in office use prior to February 1, 1990. and industrial buildings as set forth in the following (g) Other uses which, after a public hearing, are found desirable and compatible with the purposes of this district." Section 22. Section 25.41.025 (a) of said code is amended to read as follows: "(a) Structures containing more than twenty percent (20%) office area, except health services which are prohibited." Section 23. Section 25.41.070 of said code is repealed. Section 24. Section 25.42.030 (o) of said code is amended to read as follows: " (o) Offices, except health services other than clinics." Section 25. Section 25.70.030 (3) (i) of said code is amended to read as follows: "(i) Commercial and Industrial Uses. Parking spaces on the same lot shall be provided for commercial and industrial buildings as set forth in the following table of requirements: Health services 1 space for each 250 square feet of gross floor area All other offices 1 space for each 300 square feet of gross floor area It 5 Section 3 This ordinance shall be published as required by law.
