HomeMy WebLinkAboutOrd 1406ORDINANCE N0, 1406 ORDINANCE ADDING CHAPTER 10.37 TO THE BURLINGAME MUNICIPAL CODE RELATING TO INTERFERENCE WITH ACCESS TO OR THE OPERATIONS OF A LAWFUL BUSINESS The CITY COUNCIL of the CITY OF BURLINGAME does hereby ORDAIN as follows: "Section 1. Chapter 10.37 is hereby added to the Burlingame Municipal Code to read as follows: CHAPTER 10.37 OBSTRUCTION OF ACCESS TO 10.37.010 Obstruction of access to businesses. (a) No person shall willfully and maliciously block, obstruct, or otherwise impede access to or exit from any building, place, or facility at which a lawful business is conducted. (b) No person shall willfully and maliciously block, obstruct or interfere with the movement of any persons on any street, sidewalk, driveway, or other area which is open to the public and is adjacent to a lawful business. (c) No person shall willfully and maliciously remain on any portion of the premises of a lawful business which is open to the public, after being requested to leave by the person in charge of the premises or by a peace officer. 10.37.020 Definitions. The following definitions shall apply for the purposes of this chapter: (a) "Business" shall mean any person, firm, association, partnership, business trust, corporation, company or any other organization which lawfully provides or make available goods or services to members of the public, including entities organized for profit, nonprofit or charitable entities, or governmental entities. (b) "Willfully", when applied to the intent with which an act is done or omitted, means a purpose or willingness to commit the act, or make the omission referred to. It does not require any intent to violate the law, or to injure another, or to acquire any advantage. (c) "Maliciously", when applied to the intent with which an act is done or omitted, means an intent to do an unlawful act, with knowledge of its unlawfulness; or, in the alternative, to vex, annoy, or injure another person.'" Section 2. This ordinance shall be published as required by law. MAYOR I, JUDITH A.
