ORDINANCE ESTABLISHING RESPONSIBILITY FOR SIDEWALK
REPAIRS IIV R-1 ZONE
The CITY COUNCIL of the CITY OF BURLINGAME does
hereby ordain as follows:
Section 1. Section 12.12.005 is hereby added to
the Burlingame Municipal. Code to read as follows:
"12.12.005 Responsibility for damaged sidewalks.
The city shall be responsible for damaged sidewalks
caused by city street trees, as provided Section
11.04:070. City repair of damaged sidewalks shall be
made to the extent funds are provided in the annual
budget and to the extent efficient scheduling of the work
is possible. Except as provided in Section 12.10.015,
the property owner shall be responsible for all other
sidewalk repairs. As used in this chapter, 'sidewalk'
shall refer to curb, gutter, sidewalk or other such
improvements within City right of way."
Section 2_ Section 12.12.015 is hereby added
to said code to read as follows:
"Repairs in R-1. zone. If repairs or
reconstruction are necessary upon sidewalks of lots in
the R-1 zone used for single family purposes, the
property owner shall be responsible for such repairs and
reconstruction only if the condition was the result of a
negligent or intentional act of the owner or tenant of
the property or their employees or agents."

Section 3. This ordinance shall be published as
required by law,

I, JUDITH A. MALFATTI, City Clerk of the City of
Burlingame, do hereby certify that the foregoing
ordinance was introduced at a regular meeting of the City
Council held on the . 5th day of September
1990, and adopted thereafter at a re,;ular meeting of the
City Council held on the 17th day of September , 19900
by the following vote:
