ORDINANCE No. 1447
ORDINANCE REQUIRING PERMIT FOR ADDITIONS OR
MODIFICATIONS TO STRUCTURES IN THE HILLSIDE AREA
The CITY COUNCIL of the CITY OF BURLINGAME does
hereby ordain as follows:
Section 1. The title of Chapter 25.61. shall be
amended to read as follows:
"Additions to or modifications of residences in
Hillside Area"
Section 2. Section 25.61.020 of the Burlingame
Municipal Code is hereby amended to read as follows:
"25.61.020 Hillside area construction permits.
No new residence or accessory structure or any addition to
all or a portion of an existing residence or accessory
structure shall be constructed within the affected area
without a hillside area construction permit. le
Section 3. It is hereby declared that there is
a current and immediate threat to the public health, safety
and welfare and this ordinance is therefore an urgency
measure as provided by law, and will take effect upon its
adoption.
The facts constituting such urgency are as
follows: Current ordinances require a special permit for
any new residences over one story or for the addition of
second stories to existing homes in the Hillside Area, as

that is defined by the City code. Those ordinances do not
control the height or sizenew single story residences and
accessory structures or of additions to or modifications of
first stories of residences or accessory structures, with
the effect that such single story construction could result
in roof heights or structure locations which block existing
distant views of nearby properties as much or more as a
second story. It is therefore necessary that this
ordinance be adopted as an emergency measure so that
construction does not take place which would violate the
original intention of protecting existing distant views in
this area.
Section 4. This ordinance shall be published as
required by law.

ORDINANCE was introduced and adopted at a regular meeting
of the City Council held on the 4th day of November
1991, by the following vote:
