HomeMy WebLinkAboutOrd 1455ORDINANCE NO. 1455 URGENCY INTERIM ORDINANCE PROHIBITING ISSUANCE OF PERMITS FOR CERTAIN OUTDOOR LIGHTING The CITY COUNCIL of the CITY OF BURLINGAME does hereby FIND: WHEREAS, lights mounted on the exterior of buildings can interfere with the use and enjoyment of neighboring residential properties; and WHEREAS, the Council is considering zoning standards which would regulate the bulk and mass of residential structures; and WHEREAS, the Council finds that installation of exterior lights more than nine feet above landings as required by the Uniform Building Code as amended by the City of Burlingame or installation of other outside lighting so that light and glare falls upon neighboring residential properties should be regulated as part of such bulk and mass standards; WHEREAS, Government Code Section 65858 authorizes the City to adopt an urgency interim ordinance prohibiting any uses that may be inconsistent with a zoning proposal that is currently being considered or will be studied within a reasonable time, NOW, THEREFORE, be it ordained: (1) During the pendency of this ordinance the City will not issue any permits for outdoor lighting on any residential or commercial structure that is located more than nine feet above an exit landing or for any other exterior lighting installed so that the cone of light and/or glare from the light would extend onto adjacent property; (2) The Council finds that this ordinance is necessary to protect the public safety, health and welfare and that the installation of such exterior lighting prior to adoption of standards for mass and bulk would create a threat to the public health, safety and welfare; (3) This ordinance shall expire forty-five (45) days from February 19, 1992, its date of adoption, unless extended by Council prior to that date after notice and hearing, as provided in Government Code Section 65858(a). (4) This ordinance shall be published as required by law. I, JUDITH A.
