ORDINANCE NO. 1458
URGENCY ORDINANCE PROHIBITING
ISSUANCE OF BUILDING PERMITS FOR CERTAIN
OUTDOOR LIGHTING
The CITY COUNCIL of the CITY OF BURLINGAME does
hereby ORDAIN as follows:
Section 1. No building permits shall be issued
for outdoor lighting on any residential or commercial
structure that is located more than nine feet above an exit
landing or for any other exterior lighting installed so
that the cone of light and/or glare from the light would
extend onto adjacent property.
Section 2. It is hereby declared that there is
a current and immediate threat to the public health, safety
and welfare and this ordinance is therefore an urgency
measure as provided by law, and will take effect upon its
adoption.
The facts constituting such urgency are as
follows: Exterior lighting of residential and commercial
buildings and lots may exaggerate the size and bulk of
buildings. It may also create a substantial public
nuisance by intrusion into adjacent properties and
interference with the property rights and quiet enjoyment
of such adjacent properties. In order to prevent such
installations is necessary this ordinance be enacted as an
urgency measure.
