COLEMAN CITY AT RNEY CITY OF BURLINGAME 301 PRIMROSE ROAD BURLINGAME, CALIF.94010 ORDINANCE NO. 1462 ORDINANCE ADOPTING 1991 UNIFORM BUILDING, PLUMBING, MECHANICAL, AND DANGEROUS BUILDINGS CODES, 1990 NATIONAL ELECTRICAL CODE, MAKING AMENDMENTS TO SECTIONS THEREOF, AND REMOVING VARIOUS SUPERSEDED AND OUTDATED PROVISIONS The CITY COUNCIL of the CITY OF BURLINGAME does hereby ordain as follows: Section 1. The following chapters and sections of Title 18 of the Burlingame Municipal Code are hereby repealed: Chapter 18.13; Sections 18.08.050, 18.08.155, 18.08.170, 18.08.173,18.08.175,18.08.187,18.08.240,18.08.248,18.08.300, 18.08.359, 18.08.490, and 18.12.105. Section 2. The following sections of said code are hereby amended or added to read as follows: "18.08.010 Adoption of Unifbrm Building Code. The rules, regulations and requirements published by the International Conference of Building Officials tinder the title "Uniform Building Code, 1991 Edition," including Appendices 12 (Division III only), 29 (except Section 2912), 32, 353 38, 49, 51, 55, 57 and 70, and all supplements and State of California amendments thereto; under the title "Uniform Building Code Standards, 1991 Edition", and all Supplements and State of California amendments thereto; and under the title "Uniform Building Code Standards, 1988 Edition" (Standard 47-18 only), and all Supplements and State of California amendments thereto; hereinafter collectively called "building code" are adopted as and for the rules, regulations and standards within this city as to all matters therein contained except as provided in this chapter. The mandatory requirements of the appendix to the building code shall be enforceable to the same extent as if contained in the body of the building code. 18.08.020 Building inspector to file monthly report 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 JEROME F. COLEMAN CITY ATTORNEY CITY OF BURLINGAME EOI PRIMROSE ROAO BURLINGAME, CALIF 94010 It is the duty of the building inspector to file with the city council the tenth day of each calendar month a report Oat buildings inspected by him during the preceding month and of all fees received by him as building inspector. 18.08.035 Construction hours. No person shall erect (including excavation and grading), demolish, alter or repair any building other than between the hours of seven a.m. and seven p.m. on weekdays, eight a.m. and six p.m. on Saturdays, and ten a.m. and six p.m. on Sundays and holidays, except in the case of urgent necessity in the interest of public health and safety, and then only with written approval from the building official, which approval shall be granted for a period not to exceed three days. Sandblasting or similar external building cleaning shall be limited to eight a.m. to five p.m., Monday through Friday, and prohibited on holidays on such days. For the purpose of this section, holidays are the fust day of January, the third Monday of February, the last Monday of May, the fourth day of July, the first Monday of September, the eleventh day of November, the fourth Thursday in November and the twenty-fifth day of December; if the first day of January, the fourth day of July, the eleventh day of November, or the twenty-fifth day of December falls upon a Sunday, the Monday following is a holiday. 18.08.040 Section 301 (b) amended—Work exempt from permit. Subsection 1 and 2 of Section 301(b) are deleted. 18.08.056 Section 304(h) amended—Additional fees. The first sentence of Section 304(b) is amended to read as follows: (b) Permit Fees. The fee for each permit shall be as set forth in Table No. 3-A, and any additional fees which may be established or mandated by state or federal law. The value to be used in computing the building permit and building plan review fees shall be the total value of all construction work for which the permit is issued as well as all finish work, painting, roofing, electrical, plumbing, heating, air conditioning, elevators, fire extinguishing systems and any other permanent equipment. The minimum valuation shall be those set forth in the most recent edition of Building Standards published by the ICBG. 18.08.057 Section 304(c) amended—I'uUlic fees. Section 304(c) is amended to read as follows: (c) Review Fees. When a plan or other data are required to be submitted by Section 302(b), plan review fee shall be paid at the time of submitting plans and specifications for review. If the plans or other data require a handicap access review, a handicap access review fee shall also be paid at such time. Each fee shall be 65 percent of the building permit fee as shown in Table No. 3-A. The fees specified in this subsection are separate fees from the permit fees specified in Section 304(11 ), and are in addition to the permit fees. Where plans are incomplete or changed so as to require additional review, an additional review fee shall be charged at the rate shown in Table No. 3-A. 18.08.060 Certificate of occupancy. Section 308(c) is amended to read as follows: (c) Certificate Issued. After the building official inspects the building or structure and finds no violations of the provisions of this code or other laws which are enforced by the code enforcement agency, and the engineer or architect responsible for the preparation of the plans states in writing that he or she has inspected the building or structure and it substantially conforms to the approved plans and specifications, the building official shall issue a Certificate 3 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 JEROME F. (3) The name and address of the owner. (4) A description of Yhat portion of the building for which the certificate is issued. (5) A statement that the described portion of the building has been inspected for compliance with the requirements of this code for the group and division of occupancy and the use for which the proposed occupancy is classified. (6) The name of the building official. 18.08.070 Table 3-A amended—Building permit fees. The fees for valuations from $1.00 to $2,000 as set forth in Table 3-A are amended to read as follows: TOTAL VALUATION FEE $1.00 to $1000.000 $25.00 $1,000 to $2,000.00 $25.00 for the first $1,000 plus $2.00 for each additional $100 or fraction thereof, to and including $2,000. 18.08.160 Section 513 amended—Premises identification. Section 513 is amended to read as follows; Approved numbers or addresses shall be placed on all new and existing buildings in such a position as to be plainly visible and legible from the street or road fronting the property. Said numbers shall contrast with their background, shall be a minimum of one-half inch stroke by two and one-half inches high, and shall be either internally or externally illuminated from a source on the property in all new construction, alterations or repair of existing construction. The power to such illumination shall not be normally switchable. Numbers or letters shall be designated on all occupancies within a building. Directional address numbers or letters shall be provided. Said addresses or numbers shall be posted at a height no greater than 5 feet, 6 inches above the finished floor. 18.08.180 Section 1202 (b) amended --Special provisions for Group R-1 occupancies. Section 1202(b) of the Building Code is amended to read as follows: (b) Special Provisions. Group R-1 occupancies more than one story in height shall be of not less than one-hour fire resistive constriction throughout or shall be protected by a fire sprinkler system approved by the Fire Department. Notwithstanding any other provisions of this code, combustible projections from walls of such occupancies shall be one-hour fire resistive or heavy timber conforming to Section 2106. For attic space partitions and draft stops, see Section 3205. 18.08.245 Section 1701.1 added—Commercial and industrial districts. Section 1701.1 is added to read as follows: A11 new buildings hereafter constructed within, or buildings moved within and all additions, alterations or repairs to existing buildings, within the limits of the Commercial (C-1, C-21 C-3, C-4) or Industrial (M-1) districts, shall be a minimum of Type Ill 1 -hour construction as required by Chapter 20 and Table N17 -A of this code or shall be protected by a fire sprinkler system approved by the fire department. 18.08.247 Section 1713(e)3—Foam uisulation—Roofing. Section 1713(e)3 is amended to read as follows: 3. Roofi ng. Foam plastic insulation meeting the requirements of Section 1713(b), (c) . and (d) may be used as part of aroof-covering assembly, provided the assembly with the foam plastic insulation is a Class A or B fire retardant roof -covering when tested in accordance with U.B.C. CALIF. 94010 retardant roof covering assembly need not meet the requirements of Section 1713(b), (c) and (d) provided the assembly with the foam plastic insulation also meets the requirements of U.B.C. Standard No. 17-4. Any roof covering installed in accordance with this code and the manufacturer's instructions may be applied over foam plastic insulation when the foam is separated from the interior of the building by plywood sheathing not less than '/2 inch in thickness bonded with exterior glue, with edges supported by blocking, tongue -and -groove joints or other approved type of edge support, or an equivalent material approved by the Building Official. The thermal barrier requirement is waived. For all roof applications, the smoke -developed rating shall not be limited. 18.08.250 Section 2308(b) amended—Retaining walls. Section 2308(b) is amended by adding the following paragraphs: When a structure is to support a lateral load which retains fill for another structure, supports the toe of a slope which is over four feet (4') in height measured from the bottom of the footing, or is required by the City Engineer, it shall be designed by a licensed architect or engineer and approved by the City Engineer. The following types of retaining walls shall be of concrete or other material which shall have a minimum serv ice life of 75 years for all major support systems and 50 years for all replaceable support systems: Walls that are engineered, support a lateral load over 18" at property line, support an engineered surcharge, support a structure, or support a toe of a slope. A fence structure may not be substituted for a retaining wall. 1$.08.290 Section 2516(g) amended—Exterior wall coverings. Section 2907 of the building code is amended by adding subsection(j): (j) Ratproofing. Every building or portion thereof shall be made rat proof by covering the area tinder the building with concrete not less than 2 inches thick. On hillside or sloping lots where the exterior grade is higher than the rat proof grade, drainage must be provided to the satisfaction of the building official.. In lieu of such drainage, some means of preventing water from collecting tinder the house may be provided if approved by the building official. 18.08.320 Section 3203 amended—Roof covering requirements. Section 3203 is amended to read as, follows: Section 3203. All materials applied as roof covering shall have. a fire retardant rating of Class A or B, treated in accordance with U.B.C. Standard 32-7. The roof covering on any structure regulated by this code shall be as specified in Table 32-A and as classified in Section 3204. The roof -covering assembly includes the roof deck, underlayment, interlayment, insulation and covering which is assigned aroof-covering classification. 18.08.330 Section 3209 of Appendix Chapter 32 amended—Reroofing. Section 8. Al] roof covering materials used as exterior wall covering shall have afire retardant rating of Class A or B, treated in accordance with U.B.C. Detached patio covers, spa covers, gazebos, sheds (120 square feet or less of projected roof area) and awning covers are exempt from Sections 3203 and 3209. Roof covering repairs of less than 300 square feet are exempt from Sections 3203 and 3209. 18.08.370 Table 32-A—Minhnum roof classes. The permit application shall describe the streets and route over which the building will travel, the location of final installation if within the city, and the hours during which building will be moved. The building official will collect a fee of fifty dollars for required investigations and inspections. Prior to issuance of permit, the building official shall notify all affected city officials and, in the event that any such officials object to route or time of travel, changes shall be made to meet such objections. 18.09.010 Adoption of Unifm•m Mechanical Code. The Hiles, regulations_ and standards printed in one volume and published by the International Conference of Building Officials under the title "Uniform Mechanical Code, 1991 Edition," including the appendices, supplements and State of California amendments thereto, is adopted as and for the rules, regulations and standards within this city as to all matters therein contained, except as otherwise provided in this chapter. The appendices to said code shall be enforceable to the same extent as if contained in the body of the code. 18.09.020 Table 3-A amended—Fee schedule. Subsections (a) (2) of Sections 401 and 503 of said code are amended to read as follows: (2) ABS and PVC DWV piping installations shall be limited to structures not exceeding three floors above grade. COLEMAN ArroRNty CITYOOF BURIINGAME 0PRIMROSE ROAD BURLINGAME, GLIF. 94010 Section 1005 of the plumbing code is amended by adding subsection (h) to read as follows: (h) A gate shutoff valve shall be installed ou each water supply system at any accessible point where said supply enters the building, and on each apartment or dwelling; provided that where apartments or dwelling units are served by a vertical riser, in lieu of a main supply shutoff in each unit individual shutoff valves may be provided at each fixture. 18.12.130 Amendment to Section 1310—Water heater safety pans. Section 1310 is amended by adding subsection (g) to read as follows: (g) Water heater safety pans. Water heaters shall have safety pans with drains when located in living area or when leakage would do damage to the building or its contents. The pans shall be of metal and be of such dimension as to provide a minimum of two inch clearance between the pan and the outside diameter of the heater with a depth of three inches. The drain shall not be less than three-quarters of an inch. The drain shall be taken to the exterior of the building. 18.12.403 Rainwater to public gutters. No rainwater from roofs, or other rainwater drainage of premises, shall discharge upon a public sidewalk. When it is desired to conduct rainwater fr om a building or premises to a public street gutter, the outside underground drainage piping shall be vitrified clay pipe, ABS, PVC, galvanized wrought iron pipe, galvanized steel pipe, approved concrete pipe, asbestos cement sewer pipe, cast iron pipe or other materials approved by the Building Official. When clay pipe, ABS, PVC, asbestos cement sewer pipe or approved concrete pipe is used, such pipe shall be a minimum of two feet horizontally from the building and one foot below the official grade. See Section 18.08.360 for exception for such drainage in R-1 districtsI 18.16.010 Adoption of National Electrical Code. The rules, regulations and standards printed in two volumes and published by the National Fire Protection Association under the title "National Electrical Code, 1990 Edition" and the "National Electrical Code Handbook, 1990 Edition", including the appendices, the State of California amendments thereto, and the Uniform Administrative Code Provisions (LC.B.O.) of said code, are adopted as and for the rules, regulations and standards within this city as to all matters therein contained except as provided in this chapter. The fee for issuing each permit set forth in Table 3-A of the Uniform Administrative Code Provisions of the National Electrical Code is amended to read as follows: For Issuing Each Permit .................................. , .. $25.00 18.16.07 First floor defined. Subsection 336-4(a)(1) is amended to read as follows: "Types NM or NMC. Types NM and NMC cables shall not be used: (1) in any dwelling or structure exceeding three floors above grade. For the purposes of this subsection, the first floor of a building shall be as defined in Section 420 of the Building Code; ..." Section 3. GLIF.84010 17958.7 the City of Burlingame finds that the amendments to the Uniform Building Code regarding fire retardant roofs are needed and are reasonably necessary due to the various climatic, geographical and topographical elements which exist in the city. wildland fires each year. During the summer months the average temperatures in the City of Burlingame is usually between 70-90 degrees fahrenheit with light to gusty westerly winds. These drying winds, mixed with the natural vegetation which is dominant throughout the area, creates a hazardous fuel condition which has caused extensive grass and brushland fires. With more and more development encroaching into these wooded and grass covered areas, wind driven fires could have severe consequences as was evident in the Oakland Hills fire. The hilly portions of both cities contain dense shrub -type vegetation and a heavy growth of natural grasses. The city and surrounding areas suffer several wildland fires each year. The experience of several disastrous fires within Alameda, Contra Costa, Monterey and Santa Clara Counties have demonstrated the need for other fire protecfion features.
