HomeMy WebLinkAboutOrd 14651 2 3 4 5 6 7 8 9 10 ORDINANCE NO. 1465 URGENCY ORDINANCE ALLOWING SALE OF BEER OR WINE ON PUBLIC PROPERTY WITH COUNCIL APPROVAL The CITY COUNCIL of the CITY OF BURLINGAME does hereby ORDAIN as follows: Section 1. Section 10.20.010 of the Burlingame Municipal Code is amended to read as follows: "10.20.010 Consumption of alcoholic beverages upon public or private property without permission. (a) No person shall drink any alcoholic beverage: (1) On any street, sidewalk, lawn, alley, park or other public place, except as provided in subsection (b) 12 11 hereof; 13 18 19 20 21 22 23 24 25 26 JERO ME F. COLEMAN am r,TroRNEY CITY OF BURLINGAME 5PRIMROSE ROAO BURLINGAME, GLIF 94010 (2) While on private property open to public view without the express permission of the owner, his agent or the person in lawful possession thereof, (b) Beer or wine may be consumed upon public places as a part of a specific event or occasion when such consumption is specifically approved by the City Council and subject to the following conditions: (1) Beer or wine may only be dispensed upon such public places by organizations having approval to do so from the City Council. (2) Beer or wine may only be dispensed by such organizations in paper or plastic cups or containers of similar materials. 2 3 4 5 b 7 8 9 10 18 19 20 21 22 23 24 25 2U JEROME F. (4) All other laws shall be complied with, including the prohibition of sales of alcoholic beverages by bars, restaurants and stores for consumption upon such public places." Section 2. It is hereby declared that there is a need for the immediate preservation of the public health, safety and welfare and this ordinance is therefore an urgency measure as provided by law, and will take effect upon its adoption. The facts constituting such urgency are as follows: The City of Burlingame has granted permission for the sale of beer at the Broadway Festival on August 1 and 2 1992. Consumption of alcoholic beverages in public places is prohibited by Section 10.20.010 of the Burlingame Municipal Code, and it is therefore necessary that an exception be provided to said statute. Additionally, it is necessary for the protection of the public and the orderly achievement of said event and similar events in the future that limits and controls be placedupon the manner and location of dispensing and consumption of beer or wine.
