ORDINANCE PROHIBITING CIGARETTE VENDING.MACHINES

EXCEPT IN BARS

The CITY COUNCIL of the CITY OF BURLINGAME does
7
hereby ordain as follows:

Section 1. Subsection (a) of Section 8.18.010 of the
9
Burlingame Municipal Code is hereby amended to read as follows:
10
"(a) 'Bar' means an area which is devoted to the serving
11
of alcoholic beverages for consumption by patrons on the premises
12
and in which the serving of food is only incidental to the
13
consumption of such beverages. Although a restaurant may contain
14
a bar, the term 'bar' shall not include the restaurant dining
15
area."

Section 2. Subsection (o) is hereby added to Section
17
8.18.010 of said code to read as follows:

"(o) 'Tobacco vending machine' means any electronic or
19
mechanical device of appliance the operation of which depends upon
20
the insertion of money, whether in coin or paper currency, or
21
other things representative of value, which dispenses or releases
22
a tobacco product."

Section 3, Section 8.18.100 is hereby added to said
24
code to read as follows:

"8.18.100 Tobacco vending machines prohibited except in
26
bars. No person, business, or tobacco retailer shall locate,

2 install, keep maintain or use, or permit the location,
3 installation, keeping, maintenance or use on his, her or its
4 premises any vending machine for the purpose of selling or
5 distributing any tobacco product, except that vending machines
6 shall be permitted in bars, provided the vending machines are not
7 located adjacent or near any entrance of the bar."
8 Section 4. The provisions of the ordinance shall be
9 effective 90 days after its adoption.
10 Section 5. This ordinance shall be published as
11 required by law.

17 do hereby certify that the foregoing ordinance was introduced at
18 a regular meeting of the City Council held on the 7th day of
19 DECEMBER 1992, and adopted thereafter at a regular
20 meeting of the City Council held on the 4th day of JANUARY
21 199LN3 by the following vote:

PAGLIARO
