HomeMy WebLinkAboutOrd 15131 2 3 4 5 ORDINANCE No, 1513 ORDINANCE REVISING ANTENNA REGULATIONS The CITY COUNCIL of the CITY OF BURLINGAME does 6 hereby ordain as follows: 7 Section 1, Chapter 18.18 of the Burlingame Municipal 8 Code is hereby amended to read as follows: 9 "Chapter 18.18 RADIO AND TELEVISION ANTENNAS 10 18.18.010 Definitions. 11 (a) "Antenna" means any combination of wood, metal, wire or 12 other substance which either alone or in combination with any 13 supports is erected or constructed for the purpose of receiving or 14 transmitting radio, television or any other electronic or other 15 type of signal. 15 (b) "Satellite antenna" is an antenna capable of receiving 17 communications from a transmitter or a transmitter relay located 18 in planetary orbit. 19 (c) "Ham" or "CB antenna" is a radio receiving and 20 transmitting antenna for ham, amateur, citizen and/or civilian 21 band operation. 22 18.18.020 Permitted antennas 23 (1) R zones. 24 (A) Satellite, ham and CB antennas. 25 (i) Satellite, ham and CB antennas which meet the 26 following requirements may be installed with an antenna permit: 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 (a) in the rear yard and not within the side setbacks extended to the rear property line; (b) satellite antennas made of non -reflective material or painted with a non -reflective paint; screened by walls, fences or other permanent materials from view from the first floor of buildings on adjacent properties and from any public right -of way within two hundred (200) feet; and no part exceeds seven (7) feet from the ground level directly beneath it; (c) ham and satellite antennas installed on the ground and no more than twenty five (25) feet in height; (d) at a location which has least aesthetic impact upon surrounding properties while receiving usable signals. (ii) All other satellite, ham and CB antennas may only be installed with an antenna exception. (iii) Under no circumstances shall a satellite antenna exceed seven feet in diameter. (B) All other antennas. (i) Except for those antennas exempted in section (ii) hereof, all other antennas which meet all of the following requirements may be installed with an antenna permit: (a) in any area other than the front yard or the side yard setback extended to the rear property line, installed on the ground and no more than twenty-five (25) feet in height; (b) on the roof of a building and no more than ten (10) feet above the closest portions of the roof. 2 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 (ii) Antennas not meeting these requirements may only be installed with an antenna exception, provided that no permit shall be required for the following types of antennas if they meet the requirements of subsection (i) hereof: broadcast television antennas, antennas which receive or transmit signals above 100 megahertz, or satellite antennas less than 20" in diameter. (2) All other zones. (A) Except for those antennas exempted in section (B) hereof, antennas which meet all of the following requirements may be installed with an antenna permit: (i) no part thereof exceeds eight (8) feet in length or diameter or ten feet in height above the roof or ground surface upon which it is installed; (ii) no part thereof is within three (3) feet of any roof edge; (iii) if it is a satellite antenna located in the C-1 zone, it is screened from view from the first floor of buildings on adjacent properties and from any public right -of way within two (200) hundred feet by walls, fences or other permanent materials; (B) Antennas not meeting these requirements may only be installed with an antenna exception, provided that no permit shall be required for the following types of antennas if they meet the requirements of subsection (A) hereof: broadcast television antennas, antennas which receive or transmit signals above 100 megahertz, or satellite antennas less than 20" in diameter. 3 1 18.18.030 Antenna permit required. 2 Except for those antennas hereinabove exempted, no person 3 shall erect or replace an antenna without first obtaining from the 4 city planner a permit in writing to do so and paying therefor the 5 fees prescribed for such permit. 6 18.18.040 Antenna permit application — Information required. 7 Application for an antenna permit shall be made upon forms 8 provided by the city planner, and shall contain or have attached 9 thereto the following information: 10 (a) Name, address and telephone number of the applicant; 11 (b) Address and zoning district of the property on or to 12 which the antenna is to be attached or erected; 13 (c) Full description of all existing and proposed antennas; 14 (d) Written consent by owner of property; 15 (e) Site plan to scale, including dimension of the property 16 and location of the proposed antenna and all structures. 17 18.18.050 Permit fees. 18 The city planner shall charge an antenna permit fee for every 19 authorized new antenna within the city. The amount of this fee 20 shall be as prescribed by resolution of the city council and shall 21 be nonrefundable. 22 18.18.060 Exceptions. 23 (1) The planning commission may grant exceptions from the 24 regulations prescribed herein, pursuant to the procedures for 25 granting a special permit pursuant to Chapter 25.16 of this code. 26 In granting or denying an antenna exception, the following shall 27 be considered: 0 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 (A) Building height limits in the zoning district and in any adjacent zoning districts. (B) Proximity to trees and utilities, both above and below ground. (C) Visibility from and obstruction of views of adjacent and nearby properties. (D) Compatibility with adjacent zoning districts and nearby properties and uses. (E) Effect of alternative locations on reception. (F) Any health, safety or aesthetic effects of the particular location and facility. (G) Whether or not the antenna may be reasonably accommodated based upon considerations of public health, safety, welfare and aesthetics. (2) The Planning Commission may require an applicant for an exception to obtain site reception studies at his expense to determine the location with the least impact upon the health, safety, welfare and aesthetics. 18.18.070 Engineering report required. Where the gross weight of an antenna exceeds five hundred pounds or where the gross height above the ground, when built upon the ground, exceeds twenty-five (25) feet above ground level, or where the gross height above the roof, when built upon a building, exceeds fifteen (15) feet above the roof, the building official shall require that a plan and engineering calculations for wind load, bracing and foundation be prepared by a licensed civil or structural engineer. Such plans and specifications shall be 5 I prepared to meet or exceed the applicable requirements for such 2 construction as set forth in Chapter 18.08 of this code as adopted 3 or as it may be subsequently amended. 4 18.18.080 Existing antennas. 5 Antennas existing prior to the adoption of the ordinance 6 codified in this chapter and constructed or installed in 7 compliance with applicable codes shall be deemed nonconforming. 8 Antennas constructed or installed without required building or 9 other permits shall either be removed or an application for such 10 permit(s) therefor filed within thirty (30) days of the effective 11 date of the ordinance codified in this chapter." 12 Section 2. Revises regulations and limitations on all types of radio and television antennas, including limitation of dish antennas to seven feet in diameter, providing for counter permits for antennas at certain locations and under specified minimums, and special permit procedures for other antennas. Said ordinance .was introduced on October 3 1994; a public hearing thereon will be held October 17 , 1994, at 7:30 p.m. at the City Council Chambers, Burlingame City Hall, 501 Primrose Road, Burlingame, California.
