COLEMAN AnoRrver OITYOOF RURLINGAME I 501 PRIMROSE ROAO BURIJNGMIE, GLJF. 94010 1 ORDINANCE NO. 1544 INTERIM ORDINANCE PROHIBITING ISSUANCE OF BUILDING PERMITS AND DEMOLITION PERMITS ON MULTIPLE LOT RESIDENTIAL SITES The CITY COUNCIL of the CITY OF BURLINGAME does hereby ORDAIN as follows: Section 1. No building permits shall be issued for new construction, as defined by Section 25.08.477 of the Burlingame Municipal Code, upon any lot in the R-1 zone of the City of Burlingame which on May 20, 1996, is one of two or more adjacent legally subdivided lots, upon which is constructed one single family dwelling. Section 2. No demolition permits shall be issued after the date of this ordinance for any structure upon any lot in the R -i zone of the City of Burlingame which is one of two or more adjacent legally subdivided lots upon which is constructed one single family dwelling. Section 3. The Planning Commission of the City of Burlingame is hereby directed to pursue a study of the existing zoning and building ordinances applicable to such lots, that is, those described in Sections 1 and 2 hereabove, considering particularly the effects of permissible development and construction upon adjacent properties and the neighborhood. The commission shall also consider any changes in zoning or building codes which may be appropriate to preserve and protect such adjacent properties and neighborhoods. 1 2 3 4 5 6 7 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 CM JEROME F. It is hereby declared that there is a current and immediate threat to the public health safety and welfare and this ordinance is therefore an urgency measure as provided by law, and will take effect upon its adoption. The facts constituting such urgency are as follows: The City of Burlingame has numerous single family dwellings which are constructed upon two or more legally subdivided lots. Removal of the existing dwelling and construction of two or more dwellings upon the underlying subdivided lots may be incompatible and detrimental to the existing nearby residences and to the existing neighborhoods, as well as having health and safety impacts such as increased traffic and street parking. A temporary prohibition of the issuance of building and demolition permits for new construction upon such lots in the residential zones is therefore necessary so that demolition or new construction will not occur while changes in the zoning and building ordinances are considered. Section 5. Duration. This ordinance is intended to be an interim ordinance. Unless this ordinance is extended as provided by Government Code Section 65858 or superseded by any other ordinances it shall automatically cease to have force and effect forty-five days from its date of adoption.
