COLEMAN CIT'OOF BURLINGAME 3PRIMROSE ROAD BURLINGAME, GLI F.94010 ORDINANCE No. 1545 ORDINANCE ADDING PROVISIONS TO UNIFORM ADMINISTRATIVE CODE The CITY COUNCIL of the CITY OF BURLINGAME does hereby ordain as follows: Section 1. Chapter 18.07 of the Burlingame Municipal Code, the Uniform Administrative Code, is hereby amended by adding the following sections: 118.07.050 Section 204 amended — Board of Appeals. Section 204 is deleted and replaced to read as follows: An appeal of a denial of or a refusal to issue a permit or from any other decision or determination of the building official may be taken to the Planning Commission: (1) in order to determine the suitability of alternate methods materials and types of construction, and (2) to provide for reasonable interpretations of the provisions of the city building code, mechanical code, plumbing code, electrical code, and dangerous buildings code. The decision of the Planning Commission shall be written and shall be final and shall not be subject to appeal. Copies of the decisions shall be furnished to the building official and to the appellant. The Planning Commission may conduct investigations of the suitability of alternate methods, materials and types of construction. The Commission shall adopt reasonable rules regulating the conduct of such investigations and of the appeals 2 3 4 5 b 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 JEROME F. COLEMAN CM OF BURLINGAME 501 PRIMROSE ROAD BURLINGAME, CALIF. 94010 herein provided for, and may recommend to the City Council any new legislation deemed desirable. 18.07.060 Section 301.2 amended — Work exempt from permit. Subsections 1 and 2 of Section 301.2.1 are amended as follows: (a) Subsection 1 of Section 301.2.1 is amended to read as follows: 1. One-story detached accessory buildings used as tool or storage sheds, playhouses and similar uses, provided the projected roof area does not exceed 100 square feet. (b) Subsection 2 of Section 301.2.1 is deleted. 18.07.070 Section 302.2 amended — Plot plan. Section 302.2 is amended to read as follows: (a) Section 302.2 is amended by adding a phrase (shown in italics for clarity herein) to the first sentence to read as follows: 302.2. Submittal Documents. Plans (including a plot plan as described in 302.2.1)1 specifications, engineering calculations . . (b) Section 302.2 is amended by adding subsection 302.2.1 to read as follows: 302.2.1 Submit a plot (site) plan listing the lot, block and subdivision of the property and showing location of the following: the proposed construction with respect to property 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 JEROME F. COLEMAN CIW OF BURLINGAME 501 PRIMROSE ROAD BURLINOAME, CALIF. 94010 lines and other structures, etc.; any existing buildings or structures that will remain on the property; any existing building or structures that will be demolished; the existing and proposed driveways, utilities, fire hydrants, trees, power poles and any other fixed objects between property lines and curb; and an indication of the level of finish grades at various points about the parcel and at property lines, relative to an established datum such as curb or sidewalk. 18.07.080 Section 303.4 amended�xpiration of construction permit — Failure to complete. Section 303.4 of the building code is amended to read as follows: All work to be performed under a construction permit shall be completed within the maximum time allowed as set forth herein. Failure to complete the work within the time allowed, unless an extension of time has been specifically approved by the building official will cause the permit to become null and void. A new permit requiring compliance with all current codes and payment of all fees shall be required to recommence the work. The request for an extension of the time must be submitted in writing prior to the expiration of the time allowed. The fee for the first extension shall be the amount required for the original permit. The fee for the second and any subsequent extension shall be double the original permit fee 3 6 7 8 9 10 11 12 15 I6 17 18 19 20 21 22 23 24 25 26 JEROME F. If no changes in plans or specifications have been made, no additional plan checking fee shall be required for an extension. Total Valuation of Work Time Allowed $1000 or less 3 months Over $1000 to and including $10,000 6 months Over $10,000 to and including $50,000 12 months Over $50,000 to and including $1,000,000 18 months Over $1,0001000 to and including$ 2,000,000 24 months Over $2,000,000 to and including $10,000,000 30 months Over $101000,000 36 months Notwithstanding any other provision of this code, if a construction permit was issued for all or part of a project which was required to obtain a special permit, variance or traffic allocation, the construction permit shall expire and such special permit, variance or traffic allocation shall be null and void if substantial progress has not occurred within one year from the issuance of the construction permit. Substantial progress shall be defined as completion of the total basic foundation, i.e., when it has been formed, poured, inspected and approved by a city building inspector. The Council may grant an extension of a permit upon the showing by the permittee of hardship or unforeseen circumstances. 18.07.090 Section 304.2 amended — Permit Fees. 0 (a) The first sentence of the first paragraph of Section 1 304.2 is amended to read as follows: 2 The fee for each permit shall be as set forth in Tables 3-A 3 through 3-H, plus any additional fees which may be established 4 or mandated by state or federal law or city ordinance. 5 (b) The second sentence of the second paragraph of Section 6 304.2 is amended to read as follows: 7 The value to be used in computing the building permit fee, 8 the plan review fee and other fees shall be the total value of 9 all construction work for which the permit is issued as well as 10 all finish work, painting, roofing, electrical, plumbing, 11 heating, air conditioning, elevators, fire extinguishing 12 systems, etc., and any other permanent construction or 13 equipment. The minimum valuation shall be as set forth in the 14 most recent edition of Building Standards as published by the 15 International Conference of Building Officials. 16 17 18.07.100 Section 304.3 amended - Plan Review Fees. 18 Section 304.3 is amended by adding new second and third 19 paragraphs: 20 When the submittal documents require review for compliance 21 with State handicap access regulations, an access plan review 22 fee shall also be paid at the time of submittal. This fee shall 23 be 35 percent of the building permit fee as shown in Table No. 24 3-A. 25 26 5 JERO ME F. Whenever construction or work for 4 which a permit is required by this code, or any other code 5 adopted or incorporated by reference as a part of this code, has 6 been commenced without first obtaining a permit . . 7 (b) The second sentence of Section 304.5.2 is amended to 8 read as follows: 9 The Investigation Fee shall be as set forth in 18.07.110. 10 (c) The Investigation Fee shall be assessed according to 11 the following: 12 Value of Work Fee I3 $1 to $2000 Twice permit fee 14 Over $2000 Ten times permit fee 15 The maximum investigation fee which may be assessed and 16 collected as to any individual permit shall be ten thousand 17 dollars ($10,000). 18 Any person assessed such fee may file an appeal with the 19 city Clerk within ten (10) days after written notice to such 20 person of the assessment. A hearing upon such appeal shall 21 thereafter be held by the City Council; its decisions thereon 22 shall be final. Nothing in this section shall relieve any 23 persons from fully complying with the requirements of this code, 24 or with any codes incorporated by reference and made a part of 25 this code in the execution of the work, or from any other fees 26 6 JEROME F. (b) Table 3-B Electrical Permit Fees amended The fee for issuing each permit as set forth in Table 3-B is amended to read as follows: 1. For issuing each electrical permit $25.00 (c) Table 3-C Mechanical Permit Fees amended The fee for issuing each permit as set forth in Table 3-C is amended to read as follows: 1. No person shall erect (including excavation and grading), demolish, alter or repair any building or structure other than between the hours of seven a.m. and seven p.m. on weekdays, eight a.m, and six p.m. on Saturdays, and ten a.m. and six p.m. on Sundays and holidays, except in the case of urgent necessity in the interest of public health and safety, and then only with written approval from the building official, which approval shall be granted for a period not to exceed three days. Sandblasting or similar exterior building cleaning shall be limited to eight a.m. to five p.m., Monday through Friday, and prohibited on holidays on such days. For the purpose of this section, holidays are the first day of January, the third Monday of February, the last Monday of May, the fourth day of July, the first Monday of September, the eleventh day of November, the fourth Thursday in November and the twenty-fifth day of December; if the first day of January, the fourth day of July, the eleventh day of November, or the twenty-fifth day of December falls upon a Sunday, the Monday following is a holiday. 18.07.140 Building official to file monthly. report.
