ORDINANCE ESTABLISHING REGULATIONS FOR BUILDING
AND DEMOLITION PERMITS ON MULTIPLE LOT RESIDENTIAL SITES
The CITY COUNCIL of the CITY OF BURLINGAME does
hereby ordain as follows:
Section 1. Purpose. Recent development in
residential zones has often been the result of the demolition of
houses which were built upon sites which consist of two or more
legally subdivided lots. After such demolition new houses have
been built upon each of such legally subdivided lots, generally
to the maximum size allowed by current city codes. Such sites
often exist in older subdivisions consisting of houses which are
of a style and size not always compatible with contemporary
development standards. It is the purpose of this ordinance to
provide for the review ofproposed new houses upon such sites
before the demolition of the older residence, to assure that
such new residences are compatible with the patterns of
construction, size and esthetics of the particular neighborhood,
as well as to consider the impact upon traffic, utilities, and
other concerns of public health safety and welfare.

Code, to

follows:

25.08.455 Lot, standard and substandard
"Standard lot" means any lot with at least fifty (50)
feet of street frontage and lot area at least equal to the
minimum lot size designated for the area of the city by the map
attached to Ordinance 712 and any amendments thereto.
"Substandard lot" means any other lot."
Section 3. Subsections 5 and 6 are hereby added to
section 25.28.030 to read as follows:
125,28.030 Conditional uses requiring a special permit.
5. Demolition of a residential structure or an
accessory structure thereto, which structure is built over or
across two or more legally subdivided lots, and the construction
of a structure upon one or more of said lots. See section
25.28.090.
6. Demolition of a residential structure or any
accessory structure thereto, which structure is built on a site
consisting of a legally subdivided lot and a portion of another
lot which when combined with an adjacent lot will result in more
building sites than existed before the demolition of said
structures, and the construction of a structure on one or more
of said lots. See section 25.28.090."
Section 4. Section 25.28.090 is hereby added to said
code to read as follows:

125.28.090 Multiple lots developed with a single structure.
This section shall apply to all lots which are
required to obtain a special permit pursuant to section
25.28.030 (5) or (6). Demolition of existing structures or
construction of new structures upon any such lot shall not be
commenced until and unless a special permit and any variances
required by this section and a building permit are first
obtained.
In considering the special permit for either standard
or substandard lots the commission shall evaluate: (1) the blend
of mass, scale and dominant structural characteristics of the
new construction with the existing street and neighborhood; and
(2) the variety of roof line, facade, exterior finish materials
and elevations of the proposed new structures. The commission
shall also consider the necessity or mitigation for the removal
of any protected trees, as defined in section 11.06.020 of this
code, which are located within the footprint of any proposed
structure.
A variance shall be required, in addition to and as a
part of the special permit, if, on a substandard lot, the
following maximum gross floor area ratio of all structures is
not met: thirty-two (32) percent plus seven hundred and fifty
(750) square feet. Such maximum allowable house size shall be
come effective upon the issuance of a building permit for the
new construction and may not be exceeded without amendment of
the special permit.

Section 5. Ordinance 1544, adopted by this Council
on June 3, 1996, and extended by Ordinance 1548 on July 1, 1996,
shall be of no force or effect upon the effective date of this
ordinance.
Section 6. It is the intention of this council that
this ordinance apply to any site in the R-1 zone which on June
3, 1996, consisted of two or more adjacent legally subdivided
lots, upon which had been constructed one single family
dwelling, and upon which lots building permits have not been
issued for new construction.
Section 7. This ordinance shall be published as
required by law.

SUMMARY OF PROPOSED ORDINANCE
ESTABLISHING REGULATIONS FOR BUILDING
AND DEMOLITION PERMITS ON MULTIPLE LOT RESIDENTIAL SITES
Pursuant to Government Code Section 36933(c)(1) the
following is a summary of proposed Ordinance No. 1550
Requires conditional use permit for demolition or
construction of structures on R-1 lots on which a residential
structure was built over two or more legally subdivided lots.
Establishes standards for such construction. Upon adoption will
terminate urgency ordinance declaring moratorium on construction
on such lots.
Said ordinance was introduced on JULY 15, 1996; a public
hearing thereon will be held_ AUGUST 51 1996, at 7:00 p.m. at
the City Council Chambers, Burlingame City Hall, 501 Primrose
Road, Burlingame, California.
A copy of said proposed ordinance is available in the City
Clerk's office 501 Primrose Road, Burlingame, California.

September 3. 1996:

defines "standard" and "substandard" lots; establishes
procedures and review criteria for such conditional use permits.
Upon effective date terminates Urgency Ordinance 1544.
