ORDINANCE No. 1552
ORDINANCE AMENDING DEFINITIONS OF FINANCIAL INSTITUTION,
FLOOR AREA RATIO AND HOTEL, ADDING DEFINITION OF
RESIDENTIAL HOTEL AND SPECIFYING ZONES WHERE ALLOWED,
AMENDING PLATE LINE REGULATIONS FOR ACCESSORY STRUCTURES,
AND MAKING CLERICAL CORRECTIONS
The CITY COUNCIL of the CITY OF BURLINGAME does
hereby ordain as follows:
Section 1. Section 25.08.264 of the Burlingame
Municipal Code is hereby amended to read as follows:
"25.08.264 Financial institution.
"Financial institution" means a bank, savings and loan
association, loan company, credit union, credit agency,
investment company, investment counselor or manager, broker or
dealer in stocks, bonds or commodities, or similar business. Any
other similar banking or financial service offering the same or
similar services installed or established independently as a
part of another business or use and regularly staffed with one
or more persons shall be considered a financial institution.
Free standing automatic teller machines (ATM) or similar
machines dispensing only currency shall not be considered
financial institutions."
Section 2. The third paragraph of Section 25.08.265
of said code, regulating floor area ratio, is hereby amended to
read as follows:

residences are:
4. existing attic areas retained, but not extended in
a major remodel. In all other cases habitable attic area shall
be counted in calculating floor area ratio.
Section 3. Section 25.08.350 of said code is hereby
amended to read as follows:
"25.08.380 Hotel or motel.
"Hotel or motel" means an establishment consisting of a
building or a group of attached or detached buildings containing
lodging accommodations designed for use by transients, travelers
or temporary guests for short term stays. Facilities provided
may include maid service, desk service, meal and beverage
service, meeting rooms, incidental merchandise sales, barber and
beauty shops, in -room guest convenience areas without standard
kitchen appliances such as cook tops, full sized refrigerators
and full sized kitchen sink, and other incidental services and
facilities."
Section 4. Section 25.08.385 is hereby added to said
code to read:
"25.08.385 Hotel, residential
"Residential hotel" means an establishment consisting of a
building or group of attached or detached buildings contained
lodging accommodations of one or more rooms typically let for
periods of a week or more and which contain standard kitchens

and appliances and other facilities to support such extended
occupancy."
Section 5. Subsection (5) of section 25. 34.030 of
said code, specifying conditional uses in the R-4 district, is
hereby amended to read:
115. Apartment and residential hotels."
Section 6. Section 25.38.030 of said code, specifying
conditional uses in the C-2 district, is hereby amended by to
read:

3. Residential hotels;
4. Other uses similar in character to those enumerated in
this section or Section 25.36.020 which will not be obnoxious or
detrimental to the neighborhood in which they are located."
Section 7. Section 25.41.030 of said code, specifying
prohibited uses in the C-4 district, is hereby amended by adding
subsection (e) to read:
"(e) Residential hotels."
Section 8. Section 25.43.040 of said code, specifying
prohibited uses in the O -M district, is hereby amended by adding
subsection (e) to read:
"11. Residential hotels."
Section 9. Subsections 25.60.010 (g) and (h) of said
code are hereby amended to read:
"(g) The plate line of the accessory structure will be more
than eight (8) feet above grade; provided, where the lot slopes

more than ten (10) percent at the location of the accessory
structure, the eight (8) foot maximum shall apply only to the
closest point between the plate line and adjacent grade;
(h) . . .
(2) the portion of the structure at the rear property line
may have a maximum height of fourteen (14) feet if the structure
has a pitched roof on both sides and the rear plate line does
not exceed eight (8) feet above natural grade;
(3) the roof height of an accessory structure may have a
maximum height of fifteen (15) feet above grade when the roof is
pitched from ridge to plate on a least two sides and the ridge
is no closer than five (5) feet to a side property line and the
rear plate line does not exceed eight (8) feet above the natural
grade;
(4) no portion of the space within any accessory structure
between the top of plate and the lowest portion of the roof
structure including any dormer shall exceed seven (7) feet in
height."
Section 10. Section 18.18.025 (4) of said code is
amended to read:
"Any satellite antenna that does not comply with the size
and locational restrictions of this section shall not be
installed without obtaining an antenna exception as provided in
section 18.18.040".

Section 11, This ordinance shall be published as
required by law.

a regular meeting of the City Council held on the 3rd day of

Pursuant to Government Code Section 36933(c)(1) the
following is a summary of proposed Ordinance No. 1552
Amends definitions of financial institution, floor

procedure for satellite antennas.

Pursuant to Government Code Section 36933 (c)(1)
following is a summary of Ordinance No. 1552 adopted
