HomeMy WebLinkAboutOrd 15771 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 ORDINANCE No. 1577 ORDINANCE OF THE CITY OF BURLINGAME AMENDING CHAPTER 25.40 TO ALLOW A SINGLE RESIDENCE WITHIN A MOTEL OR HOTEL FOR THE MANAGER OR OWNER OF THE MOTEL OR HOTEL The CITY COUNCIL of the CITY OF BI7RLINGAME does hereby orda n as follows: Section 1. The City Council refer -ed the possible amendment of the Zoning Code to allow a single dwelling unit in a hotel or motel to allow the owner or manager to live on the property to the Planning Commission for review, and the Connnission has recommended adoption of this ordinance. The Council finds that this amendment to the Zoning Code is appropriate and will ensure and allow oversight of the operations of a hotel or motel on a round-the-clock basis and foster continued excellence in the hospitality resources of the city. Section 2. Section 25.41.020 of the Municipal Code is amended to read as follows 25.41.020 Permitted uses. The following uses are permitted in the waterfront commercial district: (a) Commercial recreation uses such as, but not limited to, bowling alleys, ice rinks, marinas and related boat sales and supplies, but expressly prohibiting outdoor motion picture theaters an d golf driving ranges; permitted uses may include the sale of merchandise and items which are related to the principal use; (b) Restauran ts; (c) Motels an d hotels: facilities provided may include meal and beverage services, barber and beauty shops, smoke shops, automobile rental desks to serv e only hotel guests so long as the operation does not use parking required for primary hotel use, convention and meeting facilities, and similar services which are clearly incidental and accessory to provision of lodging accommodations; and no more than one dwelling unit within the motel or hotel structure that is used exclusively by the owner or manager of the motel or hotel; (d) Clubs, associations, lodges and similar uses; (e) Publi c recreation areas; FI I 2 3,' 4 5 6 7' 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 (t) Office uses, except health services, in structures with a use permit pursuant to Section 25.41.025(a) or in structures in office use prior to February 1, 1990. (g) Travel agents. Section 3. Section 25.41.030 of the Municipal Code is amended to read as follows: 25.41.030 Probibited uses. Uses not listed as permitted or conditional shall be prohibited, including: (a) Manufacturing and warehousing except as designated and limited in the permitted uses; (b) Outdoor storage of merchandise and material except that boats and boat trailers may be displayed in connection with permitted marinas; (c) Residential uses including mobile homes except transient and owner/manager residence within a motel or hotel as expressly permitted above; (d) Billboards and off -premises advertising signs. Section 4. This ordinance shall be published as required by law. Mayor I, JUDITH A.
