HomeMy WebLinkAboutOrd 0922ORDINANCE N0. 922 APPROVING ANNEXATION TO TIIE CITY OF BURLINGAME OF UNINHABITED CONTIGUOUS TERRITORY DESIGNATED "WESTERLY 1/2 SKYLINE BOULEVARD ALONG M.E. 25" The City Council of the City of Burlingame does ordain as follows: WHEREAS, pursuant to the provisions of the Annexation of Uninhabited Territory Act of 1939, proceedings have been initiated by the Council of the City of Burlingame, on its own motion, to annex to the City of Burlingame all that uninhabited territory situate in the County of San Mateo, State of California, hereby designated as "WESTERLY 1/2 SKYLINE BOULEVARD ALONG M.E. 25" and particularly described in Exhibit "A" attached hereto, incorporate herein, and made a part of this Ordinance by reference; and WHEREAS, on May 20, 1970, the Local Agency Formation Commission of the County of San Mateo, adopted its Resolution No. 271, entitled "Resolution of Local Agency Formation Commission of the County of San Mateo Making Determinations and Approving the Proposed Annexation of Territory, Designated as Westerly Portion of Skyline Boulevard Right -of -Way to the City of Burlingame," wherein and whereby the annexation herein proposed was approved and the City of Burlingame was authorized to proceed without notice and hearing, pursuant to Government Code Section 35015; and WHEREAS, the City Council of said City on June 1S, 1970, adopted a resolution giving notice of such proposed annexation, and said resolution specifically described the boundaries of said territory proposed to be annexed to said City, and contained a notice of Lite day, hour and place when and where any person ownin real property within said territory so proposed to be annexed and having any objections to the proposed annexation might appear and protest against said proposed annexation; and WHEREAS, notice of said hearing was duly published and mailed as required by the provisions of Section 35311 of the Government Code of the State of California; and WHEREAS, on the 3rd day of August, 1970, at the hour of 8:00 o`clock P.M., in the Council Chambers in the City Hall of the City of Burlingame, County of San Mateo, State of California, said time and place being the day, hour and place fixed in its said resolution adopted on June 15, 1970, for hearing protests to the said annexation, the said City Council did hear and pass upon all protests to the said annexation and did determine that protests had not been made by the owners of one-half of the value of the privately -owned territory proposed to be annexed as shown by the last equalized assessment roll, nor by public owners of one-half of the value of the publicly -owned territory proposed to be annexed as determined by said legislative body; and WHEREAS, said territory is contiguous to the City of Burlingame, and is uninhabited territory in the County of San Mateo; NOW, THEREFORE, it is hereby ordered that: 1. Certain uninhabited contiguous territory situated in the County of San Mateo, State or California, and more particularly described in Exhibit "A" attached hereto, incorpor- ated herein and made a part of this ordinance by reference, be, and it hereby is annexed to the City of Burlingame, and this -2- Council does hereby approve of said annexation pursuant to the provisions of Title 4, Division 2, Part 2, Chapter 1, Article 5 of the Government Code of the State of California, entitled "Annexation of Uninhabited Territory Act of 1939," being sections 35300 to 35326 (both inclusive) of said Government Code, 2. This ordinance shall be published once in the Burlingame Advance -Star and shall be effective upon the expirati of thirty days after the date of its adoption.
