HomeMy WebLinkAboutOrd 0946ORDINANCE NO. 9�6 ADOPTING BY REFERENCE THE UNIFORM PLUMBING CODE® 1970 EDITION, WIZ AMENDMENTS, AND AMENDING §18.12.010 OF THE BURLITdGAP4E MUNICIPAL CODE AND ESTABLISHING RULES, REGULATIONS AND STANDARDS FOR THE IDI- STALLATION OF PLUMBING FIXTURES AND APPLIANCES, follows: read: The City Council of the City of Burlingame does ordain SECTION 1. ADOPTION OF 1970 UNIrORM PLUMBING CODF.e §18:12.010 of the Burlingame Municipal Code is amended 11§18.12,010 ADOPTION OF UNIFOP.P4 PLUA4BING CODE. The rule regulations and standards printed in one volume and pub- lished by the International Association of Plumbing and Mechanical Officials under the title '°Uniform Plumbing Code, 1970 Edition," including the appendixes thereto, hereinafter called plumbing code, is adopted as and for the rules, regulations and standards within this City as to all matters therein contained, except as herein other- wise provided. The mandatory requirments of the ap- pendixes to the plumbing code shall be enforceable to tY same extent as if contained in the body of the plumbing code. Three copies of the plumbing code shall, at all times, be kept on file in the office of the City Clerk.'° SECTION 2. FINDINGS. The City Council of the City of Buriingame expressly finds and determines that: (a) All of the changes or modifications to the Uniform Plumbing Code, 1970 Edition, as the same are set forth in Chapter 18.12 (Plumbing Code), Title 18 (Building Construction)of the Burlingame Municipal Code® `are reasonably necessary because of local conditions. (b) Each, every and all of such changes or modificatio were and are provisions of the Municipal Code of the Ci of Burlingame enacted on or before the effective date o California Health and Safety Code, §17958.7. (c) The code adopted by reference by this ordinance is expressly required or permitted to be adopted as a con- dition of compliance with California Health and Safety Code §17922 and pursuant to California Government Code §50022.2 may":be adopted by reference without complying with the procedures and requirements of California Government Code, Title 5, Division 1, Part 1, Chapter 1, Article 2m SECTION 3. SEVERABILITY. If any section, subsection, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City -1® Council of the City of Burlingame hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase, or portion thereof, irrespective of the fact that any one or more sections, subsections, clauses, phrases or port may be declared invalid or unconstitutional, SECTION 4, PUBLICATION, This ordinance shall be publi as required by law. `". ` YOR 1 I, HERBERT K.
