HomeMy WebLinkAboutOrd 0935ORDINANCE N0. 435 APPROVING ANNEXATIODd TO THE CITY OF BURLINGAME OF UNINHABITED TIGUOUS TERRITORY DESIGNATED -".LANDS -OF WALIGORE AND-RAVANAUGH'ON follows: ALVARADO AVENUE The City Council of the City of Burlingame does ordain a WHEREAS, pursuant to the provisions of the Annexation of Uninhabited' Territory Act of 1939, as amended, NORMAN W. KAVANp '' AUGH and HENRIETTA KAVANAUGH, his wife, and ROBERT S. WALIGORE and ROSEMARY WALIGORE, his wife, have heretofore filed their written j petition in the Office of the City Clerk of this City to annex to!, the City of Burlingame all that uninhabited territory situate in the County of San. Mateo, State of California, hereby designated i as `°LANDS OF WALIGORE AND KAVANAUGH ON ALVARADO AVENUE'° particular® 1y described in Exhibit °'A"`attached hereto, incorporated herein,', and made a part of this Ordinance by reference; and WHEREAS, on April 21, 1971, the Local Agency Formation Commission of the County of San Mateo, adopted its resolution no. 314, entitled "Resolution of Local Agency Formation Commission of the County of San Mateo Making Determinations and Approving the Proposed Annexation of Territory, Designated as Lands of Waligore and Kavanaugh on Alvarado Avenue to the City o£ Burlingame,'° wherein and whereby the annexation herein proposed was approved and the City of Burlingame was authorized to proceed without notice and hearing, pursuant to Government Code §35015 and 54797.1; and WHEREAS, said petitioners are the owners of all of the lands within the territory proposed to be annexed and have con- sented, in writing, that said lands shall be taxed or assessed by the City of Burlingame to pay any indebtedness or liability of the City contracted prior to or existing at the time of an� nexation; and -1- WHEREAS, said territory is continguous to the City of Burlingame, and is uninhabited territory in the County of San Mateo; NOW, THEPEFORE, YT IS HEREBY ORDERED THAT: 1. Certain uninhabited contiguous territory situated in the County of San Mateo, State of California, and more particular) described in Exhibit "A" attached hereto, incorporated herein and made a part of this ordinance by reference, be, and it is hereby annexed to the City of Burlingame, and this Council does hereby approve of said annexation pursuant to the provisions of Title 4, Division 2, Part 2, Chapter 1, Article 5 of the Government Code of the State of California, entitled "Annexation of Uninhabited Territory Act of 1939," being §535300 to 35326 (both inclusive) of said Government Code* 2° This ordinance shall be published once in the Burlin game Advance Star and shall be effective upon the expiration of thirty days after the date of its adoption. ABSENT: COUNCILMEN: N®rie° ° White, Cxty ale EXHTBIT A All that real property situated in the County of San Mateo, State of California, particularly described as follows: Lot 1 and a portion of Lot 2, B1ocY. 1, Burlingame Hills Subdivision No. 2, as designated on the map filed in the office of the County Recorder, August 23, 1926, in Volume 14 of Maps, Pages 18 and 19, more particularly described as follows: Beginning at a point in the corporate limits line of the City of Burlingame said point being the most northerly corner of Lot 1 Block 1, as shown on said Burlingame Hills Subdivision No. 2; running thence along said limits and the southwesterly line of Alvarado Avenue south 55°04' east, a distance of 185.76 feet to the westerly line of that certain area designated "Driggs Property" annexed to the City of Burlingame by Ordinance No. 516 adopted September 4, 1951 by said city council, thence along said west line and said limits, south 34°56' west 206.26 feet to the easterly line of that certain area designated "Hillside Reservoir Site" annexed to said city by ordinance No. 480 adopted June 6, 1949, by said city council, thence along the general easterly line of said Hill- side Reservoir Site and said limits, north 40004' west 52.63 feet north 53004' west 135.00 feet to the southeasterly line of a 20 foot public lane; thence along said southeasterly line north 34° 56' east 187.93 feet to the point of beginning.
