HomeMy WebLinkAboutOrd 15891 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 ORDINANCE No. 1589 ORDINANCE OF THE CITY OF BURLINGAME ADOPTING AN INTERIM ORDINANCE PURSUANT TO GOVERNMENT CODE SECTION 65858 PROHIBITING THE ISSUANCE OF ANY BUILDING OR CONSTRUCTION PERMITS OR ACCEPTANCE OF ANY PLANNING APPLICATIONS FOR CERTAIN CONSTRUCTION OF OR ADDITION TO ANY SECOND OR TALLER STORY IN ANY R4 DISTRICT OF THE CITY The CITY COUNCIL of the CITY OF BURLINGAME does hereby ordain as follows: Section 1. Government Code Section 65858 allows the City of Burlingame to adopt an interim ordinance to protect the public health, safety, and welfare to prohibit uses that maybe in conflict with a contemplated zoning proposal being studied by the City Council or the City Planning Commission. The City of Burlingame's single-family neighborhoods consist of a variety of modest homes harkening back to bungalow, mediterranean, and California architectural styles, and the Planning Commission is currently studying proposals that would apply design standards or otherwise regulate construction of structures in the R-1 Districts of the City that are more than one story in height. The current economic boom in the Bay Area has given impetus to building larger and larger homes. Because construction of tall, massive homes irreversibly threatens the neighborhood integrity that makes Burlingame such a special place to live, continued issuance of planning approvals and permits in light of these concerns and without adequate review would make the Planning Commission's proposed regulations ineffective. Therefore, it is imperative to preserving the City's single-family neighborhoods that the Planning Commission and the City Council be given time to develop, consider, and adopt regulations regarding second and higher stories of structures in the R-1 Districts that will be effective and meaningful. Section 2. During the effective period of this ordinance, the City shall not issue any building or construction permit for any construction that would allow any addition to or construction of a second story or higher of any structure in any R-1 District of the City if Lite addition or construction would: it 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 a) Increase the floor area ratio on a lot to more than forty-five (45) percent, or b) Increase the gross floor area on a lot to more than 2,700 square feet, whichever is more. Section 3. During the effective period of this ordinance, the City shall not accept for filing any application for an approval pursuant to the City Zoning Code of any addition to or construction of a second story or higher of any structure in any R-1 District of the City if the addition or construction would: a) Increase the floor area ratio on a lot to more than forty-five (45) percent; or b) Increase the gross floor area on a lot to more than 2,700 square feet, whichever is more. Section 4. a) This ordinance shall not apply to the following: i) Any project for which a complete building or construction permit application was filed or approved for an addition to or construction of a second story or higher before 5 p.m. on March 16, 1998; or ii) Any project for which a complete planning application was filed or approved for an addition to or construction of a second story or higher before 5 p.m. on March 16, 1998. b) During the effective period of this ordinance, no approval shall be granted for any amendment to any appli cation or permit that is exempt pursuant to this Section if i) The amendment to the application or permit would increase the gross floor area or the floor area ratio on the lot above the maximum limits stated in Section 2 or 3 above; or ii) Ifthe application on file or pernut approved by March 16, 1998, proposed a gross floor area. or floor area ratio that already exceeded the maximum limits stated in Section 2 or 3 above, the amendment to the application would increase the gross floor area or the floor area ratio on the lot even further. 2 1 2 3 4 5 6 7 8 9' 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Section 5. The City Planner shall provide a report to the City Council for review no later than April 6, 1998, regarding the progress in developing the regulations being studied by the Planning Commission. Section 6. This ordinance shall take effect immediately. Section 7. This ordinance shall be published as required by law. This ordinance shall automatically be of no further force and effect on April 21, 1998, unless the ordinance is extended by action of the City Council before that date. I, JUDITH A. The ordinance includes a definition for "investment advisor or broker," so that the Zoning Code could utilize this definition in home occupation terms, as it does attorneys and accountants. The ordinance also clarifies the limitations on ATM's and the placement of financial institution operations in other businesses. The amendment will generally mean that a securities broker or financial advisor will become an office use and treated much like law offices and accountancy firms, regardless of the number of employees in the office. The proposed ordinance includes a definition for "investment advisor or broker," so that the Zoning Code could utilize this definition in home occupation terms, as it does attorneys and accountants.
