The City Council of the City of Burlingame does ordain as follows: Section 1: Title 25 (ZONING) of the Municipal Code is '.,amended by adding a new section numbered 25.08.265 which shall ''...read and provide as follows: "§25.08.265 Floor area ratio (FAR) Floor area ratio. (FAR) as used herein shall apply to the gross floor area of the building above the average elevation of the curb opposite the front wall and shall not include basements and cellars. Chimneys, flagpoles, transmission towers, fire or hose towers, cupolas, water tanks or other mechanical appurtenances, and elevator penthouses are excepted from the computation of the floor area ratio. For parking structures and buildings having enclosed space without floors, each twelve feet (12') in height shall be considered as a story. In addition, each frac- tion of twelve feet (12') in height shall be calculated as a fraction of a story. The calculated gross floor area of parking structures, auditoriums and other build- ings with large enclosed spaces shall be determined by multiplying the covered lot area by the equivalent num- ber of stories plus any fraction thereof. For a project including both types of structures the floor area ratio shall be determined by adding the floor area of the building to the calculated gross floor area of the building or structure with large enclosed space without floors, and dividing by the total lot area of the project." Section 2: §25.24.010 is amended to read and provide as follows: "§25.24.010 Amount and disposition of fees Fees shall be paid in such amounts as the City Council may determine from time to time by resolution. All fees shall be paid to the City and credited to the general fund". Section 3: §25.32.030 of the Municipal Code is amended by adding subparagraph 4 which shall read and provide as follows: "4. Any structure that is more than thirty-five feet (35') in height". - 1 - Section 4: §25.34.030 of the Municipal Code is amended ',by adding subparagraph 7 which shall read and provide as follows: "7. Any structure that is more than thirty-£ive feet (35') in height". of the Municipal Code is amended Section 5: §25.36.030 of the Municipal Code is amended ,by adding subparagraph 8 which shall read and provide as follows: "8. Any structure that is more than thirty-five feet (351) in height". Section 6: §25.36.040 of the Municipal Code is amended 'by adding subparagraph 3 which shall read and provide as follows: °'3. Roo£ signs". Section 7: §25.36.070 of the Municipal Code is amended 'Ito read and provide as follows: "§25.36.070 Height and bulk of buildings. Every building hereafter constructed, reconstructed or relocated upon any lot or lots in a C-1 District shall not exceed a height determined by its relation to the area of the lot or lots upon which the building is located in the ratio of three square feet of building to one square foot of land. (FAR = 3.0)". Section 8: Title 25 (ZONING) of the Municipal Code is lamended by adding a new section numbered 25.41.025 which shall 'read and provide as follows.: "§25.41.025 Conditional uses requiring a special permit.:. The following uses are permitted with a permit from the city council. 1. Buildings and structures that exceed thirty-five feet (351 ) in height when located within one hundred feet (100') of the San Francisco Bay shoreline, or area that is within jurisdiction of the San Francisco Bay Conservation and Development Commission (BCDC). 2. All buildings and structures that exceed fifty feet (50') in height. 3. Projects having a Floor area ratio of more than one (FAR that exceeds 1 .0)." - 2 - Section 9: Title 25 (ZONING) of the Municipal Code is amended by adding a new section numbered 25. 41.090 which shall read and provide as follows: "§25.41.090 Height and bulk of buildings. For every project hereafter constructed or recon- structed in a C-4 District, the floor area ratio (FAR) shall not exceed 2.0. The building height and bulk is determined by its relation to the area of the lot or lots upon which the building is located in the ratio of two square feet of building to one square foot of land." Section 10: §25.42.030 of the Municipal Code is amended by adding subparagraphs p and q which shall read and provide as follows: "p. Any use with a structure that is more than thirty- five feet (35') in height. q. Any use with a structure that covers more than sixty per cent (60o) o£ the lot area. Section 11: §25.42.040 of the Municipal Code is amended by adding subparagraph £ which shall read and provide as follows: '°f. Roof signs." Section 12: Title 25 (ZONING) of the Munioipal Code is amended by adding a new section numbered 25.74.025 which shall ! read and provide as follows: "§25.74.025 Lapse of special permit for nonuse. If the use for which such special gasoline service station permit shall have been granted shall be discon- tinued for a period of six consecutive months, such special permit shall terminate, and the property shall then be subject to the permitted uses and regulations provided for in the district in which such property is situated. A special permit granted under the provisions of this chapter shall terminate at the expiration o£ one year from the date of issuance unless the property af- fected thereby shall have been used or occupied in con- formity with such permit." - 3 - Section D: Publication. This Ordinance shall be published once as required by law. I, HERBERT K.
