ESTABLISHING RATES OF SEWER RENTAL CHARGES
E M E R G E N C Y
The City Council of the City of Burlingame does ordain
as follows:
Section 1. § 15.08.070 of the Municipal Code of the
City of Burlingame is amended to read and provide as follows:
"� 15.08.070 Sewer rental - Service Charges.
Every person whose premises in the city are served by a
connection with the system of sewerage of the city whereby
the sewage or industrial wastes, or either or both, are dis-
posed of by the city, either through the facilities of the
sewage treatment and sewage disposal works of the city, or
otherwise, shall pay a sewer rental charge based upon the
quantity of metered water used in or upon such premises of
twenty-four cents per thousand gallons of water so measured,
whether such water is derived from a source other than the
city water supply or all or any part of such water is fur-
nished to said premises without charges; provided, however:
1. That a minimum monthly rate of ten dollars
shall be charged and collected from all premises having
a connection with the sewerage system of the city and
not using city water;
2. That every person whose premises outside of

the city are served by a connection with the system of
sewerage of the city shall pay a sewer rental charge
based upon the quantity of metered water used in or upon
such premises of thirty-seven cents per thousand gallons
of water so measured."
Section 2. URGENCY, It is hereby declared that this
ordinance is an ordinance for the immediate preservation of the
public peace, safety, health and welfare, and is an emergency mea
sure as provided by law and shall take effect upon its final pas-
sage.
The facts constituting such urgency are as follows:
Current sewer rental charges were adopted on May 4,
1970, and became effective 30 days thereafter. Since that date,
operating and maintenance costs of the Wastewater Treatment Works
and of the Main Sewage Pump Station have increased substantially
and the 1974-1975 budget allocation for these facilities will re-
sult in a substantial deficit during the present fiscal year and
a much larger deficit in 1975 - 1976. The increase in rates re-
flected by this ordinance is not sufficient to prevent a deficit
but is intended to reduce it materially.
Limitations imposed by the state legislature on in-
creases in the general levy make it appropriate to reduce the
deficit by increase in the sewer rental charges rather than by an
increase in the general levy.
Increase in the rates by an ordinance adopted in the
regular manner, rather than by this urgency ordinance, would not
permit the same substantial reduction of the deficit that will be
accomplished by the adoption of this ordinance as an urgency

measure.
Section 3, This ordinance shall be published as re-
quired by law.
