ORDINANCE
PROVIDING FOR
A MORATORIUM
ON THE
CONVERSION
OF STRUCTURES
TO CONDOMINIUMS
defined as those words are',
defined in California
Civil Code,
§1350.
E M E R G E N C Y
The City Council of the City of Burlingame does ordain
as follows:
Section 1: Moratorium. A moratorium is hereby placed
on the approval of the conversion of any real property or existing

building or other structure to
a condominium project

11, 1974.
Section 2: Permit Suspensions. No approval shall be
given during the period provided in Section 1, above, to any ten-
tative subdivision map or to any parcel map, of any real property
proposed as a condominium project, unless the project is for the
construction of entirely new buildings or structures and no build
ing, filling, grading, demolition or other permit shall issue dur
ing said period for any such conversion.
Section 3:
Definitions.
The
words "condominium" and
"project" as used in
this ordinance
are
defined as those words are',
defined in California
Civil Code,
§1350.
Section 4:
Severability.
If
any section, subsection,
subdivision, paragraph,
sentence,
clause
or phrase of this ordinance
or any part thereof,
is for any reason
held to be unconstitutional''
or invalid, or ineffective
by any
court
of competent jurisdiction,'

such decision shall not affect the validity or effectiveness of
the remaining portions of this ordinance or any part thereof. The
City Council hereby declares that it would have passed each sec-
tion, subsection, subdivision, paragraph, sentence, clause or
phrase thereof, irrespective of the fact that any one or more
sections, subsections, subdivisions, paragraphs, sentences,
clauses or phrases be declared unconstitutional or invalid or in-
effective.
Section 5: Publication. This Ordinance shall be
'',published once as required by law.
Section 6: Urgency. It is hereby declared that this ',
,ordinance is an ordinance for the imm
ediate preservation of the
public peace, safety, health and welfare and is an emergency mea-
sure as provided by law and shall take effect upon its final
passage and adoption.
The City Council finds that the moratorium must be im-
'posed in order to preserve the health and safety of all prospective
buyers or renters of such condominium projects as are affected by
this ordinance; in order to consider the effects of conversions
upon the housing element of the general plan, presently under
study; in order to determine the effects of conversions upon the
density regulations of the general plan; and in order to protect
the citizens of the City of Burlingame in the preservation and im-
provement of aesthetic and environmental conditions within the
City.
