ADDING CHAPTER 12.10 TO THE BURLINGAME
MUNICIPAL CODE TO PROVIDE FOR ISSUANCE
OF ENCROACHMENT PERMITS
The CITY COUNCIL of the City of Burlingame does
ORDAIN as follows:
Section 1. Chapter 12.10 concerning encroachment
permits is hereby added to the Burlingame Municipal Code to
read as follows:
"Chapter 12.10
ENCROACHMENT PERMITS
12.10.010 Policy.
It is the policy of the City of Burlingame that
rights-of-way of the City shall be used for public pur-
poses and that permission to encroach thereon shall be
given only when exceptional or unusual circumstances
are presented, or when there is no reasonably foresee-
able requirement for City use of the right-of-way.
12.10.020
No person without first obtaining a permit shall
construct or place an encroachment within, on, over or
under a right-of-way of the City. Encroachment shall
include any tower, pole, pipe, fence, building, or any
other structure or object of any kind. This chapter shall
apply if a permit other than a building permit is not
otherwise required by this ordinance code.
12.10.030
Any person, firm or corporation desiring such
a permit shall make a written application to the City
Engineer setting forth the purpose and extent of the
work to be performed or caused to be performed by
such person. Accompanying such application shall be

deposited with the City Engineer a fee in the sum of
ten dollars ($10.00).

The City Engineer may grant the request for an en-
croachment permit in whole or in part, subject to such
conditions as he may determine are necessary for the health,
safety,
and general
welfare of
the.
public.
Any pern.it
shall be
revocable
by the City
upon
written
notice.
12.10.050
Any decision of the City Engineer concerring an en-
croachment permit may be appealed by the applicant to the
city council. Such appeal shall be made in writing
within five (5) days after written notice of the decision
o£ the city engineer is sent to the applicant. Addition-
ally, all decisions of the city engineer shall be reported
to the city council and shall not be final until the
conclusion of the city council meeting at which such
report is received.
12.10.060
In the event that an appeal is taken, the matter
shall be referred to the city council for hearing. At
the conclusion of the hearing the city council shall
make its order approving, modifying, or reversing the
action of the city engineer. The decision of the city
council shall be final and conclusive. All permits
shall be recorded with the San Mateo County Recorder."
Section 2. This ordinance shall be published as requires

at a regular meeting of the City Council held on the 17t day of
November, 1975, and adopted thereafter at a regular meeting of
