ORDINANCE NO. 1641
ORDINANCE OF THE CITY OF BURLINGAME
AMENDING TITLE 25 TO PROVIDE A SPECIAL PERMIT PROCESS FOR
DETACHED GARAGE DIMENSIONS, TO PROHIBIT WAREHOUSE STORAGE IN
C4 AND C-2 DISTRICTS, AND TO CLARIFY TIME LIMITS ON THE EXERCISE
OF ZONING APPROVALS
The CITY
COUNCIL of the CITY
OF BURLINGAME does
hereby ordain as
follows:
Section 1.
To ensure that the
central retail areas of the
City retain their
pedestrian
chazacter and retail frontage, it is important to remove warehousing from the C-1 and C-2 districts.,
and this ordinance removes warehousing as a permitted use The current Zoning and Subdivision
Codes are not clear on the time frames in which a condominium permit may be valid, and the State
has continued to extend tentative map approvals far beyond any prior expectation. The
accompanying permits are often essential to construction of an approved condominium map. This
ordinance makes a condominium permit, conditional use permit, special permit, or variance approval
in connection with a condominium project run concurrently with the underlying tentative map
approval. This ordinance also specifies a detached garage dimension exception as a special permit
review.
Section 2. Section 25.28.035 is amended to read as follows:
25.28.035 Uses Allowed with a special permit.
The following are uses allowed in the district with a special permit:
1. Attached garages for single family dwelling units.
2. Reduction in the number of parking spaces existing on site.
3. Construction exceeding the limits of the declining height envelope.
4. A detached garage located within the rear forty (40) percent of the lot.
5. An accessory structure that is in the rear of the lot and that is more than twenty-eight
(28) feetin width or depth.
Section 3. Subsection 25.28.073(2)(d) is amended to read follows:

Section 4. Anew subsection 25.36.045(5) is added as follows:
5. Warehouses for storage of furniture, household, personal, or other similar articles or
outdoor commercial storage.
Section 5.

detached garage or
other one-story accessory buildings located within the rear thirty
(30)
percent
of the length of the
lot line.
Section 4. Anew subsection 25.36.045(5) is added as follows:
5. Warehouses for storage of furniture, household, personal, or other similar articles or
outdoor commercial storage.
Section 5.
Subsection 25.38.020(21) is
deleted,
and current subsection 25.38.020(22)
is renumbered as
subsection 25.3 8.020(2 1),
25.16.130 Time
limits for
Section 6. Anew subsection 25.38.035(5) is added as follows:
5. Warehouses for storage of furniture, household, personal, or other similar articles or
outdoor commercial storage, except automobile storage as allowed pursuant to this chapter.
Section 7. Subsection 25.38.031(a) is amended to read as follows:
(a) Uses allowed in subarea D. Notwithstanding any other provision of this chapter, any
residential use or retail use other than those related to automobile sales, service, and storage shall
be allowed only with a special permit in subarea D of the Burlingame Avenue Commercial Area.
Section 8.
Section
25.16.130 is
amended
to read as follows:
25.16.130 Time
limits for
exercise of
variance,
conditional use permit,
special permit, or
condominium permit.
(a) Where a use is conditional upon the granting of a variance or the issuance of a
conditional use permit or special permit, such use shall be commenced within a period of one year
from the date of the granting of the variance or the issuance of the conditional use permit or special
permit, and in the event that such use shall not have been so commenced within such period, such
variance or permit shall become null and void. The commission is authorized to grant an extension,
or extensions, for a period not exceeding one year upon application.

(b) However, where a variance, conditional use permit, special permit, or condominium
permit has been granted or issued for conversion or development and construction of a
condominium pursuant to Title 26, the variance or permit shall become null and void when the
tentative map for the condominium expires because no final map has been filed pursuant to State
law and this code, rather than the time limits specified in subsection (a) above.
Section 9. This ordinance shall be published as required by ►aw.
