ORDINANCE OF THE CITY OF BURLINGAME INCREASING THE MONETARY
LIMITS OF PUBLIC PROJECTS THAT CAN BE AWARDED BY INFORMAL
BIDDING PROCEDURES UNDER CERTAIN CIRCUMSTANCES AND
CLARIFYING DELEGATION OF CITY MANAGER'S DUTIES
The CITY COUNCIL of the CITY OF BURLPVGAIvIE does hereby ordain as follows:
Section 1. The Uniform Public Construction Cost Accounting Act, Public Contract
Code sections 22000 and following, allows the City to establish certain values atwhich different
bidding and award procedures may be used to expedite contracting and public works
construction, while sustaining a cost-effective system. Pursuant to Public Contract Code section
22020, the California Uniform Construction Cost Accounting Commission has recommended
and the State Controller has adopted adjustments to the monetary limits found in Public
Contract Code section 22032, effective on July 1, 2000. This ordinance will adopt similar limits
as provided by the Public Contract Code. Section 2.28.010 also requires some change to ensure
that its reference to purchases of services and materials is clear, but the change is not intended,
nor should it be construed, as a change in procedures that are currently be used.
Section 2. Section 2.28.010 is amended to read as follows:
2.28.010 Informal bid procedures.
(a) Public projects, as defined by the Uniform Public Construction Cost Accounting Act,
Sections 22000 et sea • of the Public Contract Code, of seventy-fi
ve thousand dollars ($75,000)
or less may be let to contract by informal procedures as set forth in Sections 22032 et sea,
of
that code.
(b) When authorized by the city manager, public projects, as defined by the Uniform
Public Construction Cost Accounting Act, Sections 22000 et seq. of the Public Contract Code,
of more than seventy-five thousand dollars ($75,000) but equal to or less than
one hundred
thousand dollars ($100,000) may be let to contract by informal procedures as set fort

(c) Whenever an open purchase order for materials or supplies exceeds $25,000 in a
fiscal year, it shall be either informally or formally bid as if it were a public project under this
section for subsequent fiscal years, until such time as the annual expenditure is less than
$25,000.
Section 3. Section 3.04.030 is amended to read as follows:
3.04.030 Delegation, absence, or disability.
(a) The city manager may delegate the performance of duties of the manager specified
in this code to others unless otherwise expressly provided by action of the council. However,
the city manager will remain responsible to the city council for the proper performance of those
duties.
(b) In case of absence or disability of the city manager, the city council may designate
a duly qualified person to perform the duties of the city manager.
Section 4. This ordinance shall be published as required by law.
