ORDINANCE NO. 1702
ORDINANCE OF THE CITY OF BURLINGAME
AMENDING TITLE 25, ZONING CODE, TO DEFINE BEAUTY SHOP AND
BARBERSHOP AND TO REDEFINE HEALTH AND BEAUTY SPA AS PERSONAL
TRAINING AND ASSESSMENT BUSINESS
The CITY COUNCIL of the CITY OF BURLINGANIE does hereby ordain as follows:
Section 1. On July 1, 2002, in Ordinance No.1691,the City Council adopted an ordinance
allowing health and beauty spas to operate in certain locations in the City's C-1 Districts.
However, it has been determined that the type of health and beauty spas that can be successful in
the City's C-1 Districts cannot meet the retail sales requirements adopted in that ordinance. This
ordinance is intended to remove that retail sales requirement while at the same time limiting health
and beauty spas from hosting group instruction and thereby becoming a personal trainer and
assessment business. This ordinance also provides a definition of beauty shop.
Section 2. Anew section 25.08.124 is added as follows:
25.08.124 Beauty shop or barbershop.
"Beauty shop" or "barbershop" mean
s a personal service business conducted by barbers,
cosmetologists, electrologists, estheticians, or manicurists licensed bythe state. Services pro
vided
may include nail care; hair cutting, styling and treatment; and skin care and treatment, including
facials, cosmetic application, waxing and body wraps. A beauty shop or barbershop may include
massage when conducted in accordance with the requirements of chapter 6.40 of this code.
Secfion 3. Section 25.08.335-1 is repealed.
Section 4. Anew Section 25.08.523 is added to read as follows:
25.08.523 Personal trainer and assessment business.
"Personal trainer and assessment business" mean
s a personal service business focused on
fitness analysis and training for individuals. To qualify as a personal serv
ice under this definition,
each professional shall be limited to serving no more than two (2) clients at any one time; no group

instruction of three (3) or more clients shall take place on the premises. The business may include
retail sales.
Section 5. Subsection 25.36.020(4) is amended to read as follows:
4. Beauty shop or barbershop.
Section 6. Subsection 25.36.030(q) is amended to read as follows:
(q) Personal trainer and assessment businesses;
Section 7. Subsection 25.36.040(b)(1)(J) is amended to read as follows:
(J) Personal trainer and assessment businesses below the first floor only.
Section 8. Subsection 25.36.041(b)(3) is amended to read as follows:
(3) Personal trainer and assessment businesses on the first floor or above; and
Section 9. This ordinance shall be published as required by law.
