ORDINANCE OF THE CITY OF BURLINGAME AMENDING SECTION 25.36.041
TO ALLOW FINANCIAL INSTITUTIONS AS CONDITIONAL USES
IN THE BROADWAY COMMERCIAL AREA
The City Council of the City of Burlingame ordains as follows:
Section 1. The economic and social health of the Broadway Commercial Area is a vital part of
the Burlingame community. Broadway merchantsandpropertyownershaverequestedtheCitytoloosen
some of the controls that were put in place to sustain the retail character of the area, so there is more
flexibility in tenants and business opportunities. This ordinance will allow financial institutions as a
conditional use so that the size, frontage, traffic impacts of locating such a use at a specific property in
the area can be evaluated, while at the same time providing an opportunity for such a business. The
ordinance change will only last for two years, so that it can be reevaluated for its effect on the area.
Section 2. Section 25.36.041 is amended to read as follows:
� 25.36.041 Broadway commercial area.
(a) Permitted uses in the Broadway Commercial Area. Except as otherwise provided in this
� section, uses permitt
ed in the C-1 district are permitted uses in the Broadway Commercial Area
(b) Conditional uses in the Broadway Commercial Area. In addition to the conditional use
allowed in the C-1 district, the following uses are only allowed in the Broadway Commercial Area
pursuant to a conditional use permit:
(1) Food establishments;
(2) Graphics arts and design retail businesses on the first floor only;
(3) Personal trainer and assessment businesses on the first floor or above; and
(4) Health services above the first floor only.
(c) Prohibited uses in the Broadway Commercial Area. In addition to the uses prohibited in the
district, the following uses are prohibited in the Broadway Commercial Area:
(1) Real estate;

(2) All other offices on the first floor; and
(3) Psychic services.
Section 3. This ordinance shall be effective
until
March
31, 2006, unless earlier
repealed,
and
shall have no further force and effect beyond that
date.
If the
ordinance ceases to be
effective,
the
provisions of Section 25.36.041 in effect when this ordinance was adopted shall be reinstated unless
otherwise provided by an ordinance subsequent to this one.
Section 4. This ordinance shall be published as required by law.

Would you please place a corrected copy of Ordinance No. 1730 in the City file as enclosed? The
Council adoption of the ordinance on March 1, 2004, was for a 24 -month period. Section 3 of the
ordinance that was originally signed had a typographical error specifying March 31, 2005. That
should have been March 31, 2006. It has been corrected in the attachment.
