HomeMy WebLinkAboutOrd 17724 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 ORDINANCE No. 1772 ORDINANCE OF THE CITY OF BURLINGAME AMENDING MUNICIPAL CODE SECTION TO CORRECT POSSIBLE SAFETY ISSUE ON SWIMMING POOL BARRIERS The CITY COUNCIL of the CITY OF BURLINGAME does hereby ordain as follows: Section 1. The City has adopted strict standards for barriers around swimming pools to enhance public safety. One ofthe requirements regarding maximum opening size, however, may lead to creation of a possible safety issue. Therefore, this ordinance places the barrier requirement spacing under the California Building Code and eliminates the maximum square size of opening. Section 2. Subsection 23.01.050 is amended to read as follows: (a) A fence entirely enclosing the pool, hot tub or spa or yard containing it shall be erected and maintained. Such fence shall not be less than four feet six inches, nor more than six feet in height. All gates must be self-closing and self -latching, and the latch or lock shall be located at least four feet six inches above the surface of the underlying ground or floor. A space at least four feet in width shall be provided between the line of the fence and the edge of the unit. Fencing is to be constructed and approved before filling the unit. Section 3.
