HomeMy WebLinkAboutOrd 1844OF THE CITY OF BURLINGAME MENDING CHAPTER 15.08 TO REVISE WASTEWATER COLLECTION ,,,' RATES q ,; CHARGES : The CITY COUNCIL of the CITY OF BURLINGAME does hereby ordain as follows: Section 1. Notice of proposed revisions to the City's sewer rates, of the amounts of those rates, of the reasons for the revisions and of the public hearing set before the City Council to consider and adopt the revised rates was mailed to each ratepayer and owner of record in the City and duly published in a newspaper of general circulation in the City. The City Council, after conducting the public hearing and after due study and deliberation, has determined that the rental rate for sewer service to customers must be increased to balance increased costs and improvements and to continue to fund necessary reconstruction. In the construction and maintenance of the City sewer system, the City general fund has contributed significant amounts of money to build, maintain, and operate the system. Section 2. Section 15.08.070 of the Burlingame Municipal Code is hereby amended to read as follows: (a) Every person whose premises in the city are served by a connection with the system of sewerage of the city, whereby the sewerage or industrial wastes, or either or both, are disposed by the city, shall pay a bimonthly sewer charge based upon the quantity of metered water per bimonthly billing period as set forth in the following rate schedules, whether such water is derived from a source other than city water supply or all or part of such water is furnished to the premises without charge. The director of public works shall determine the classification of uses not specifically listed. The finance director shall have the discretion and authority to establish a different sewer charge when circumstances such as water leaks or unseasonable or atypical water usage cause established rates to result in inequitably low or high sewer charges; any such determination shall be reviewed by the city manager upon request from the customer. The finance director may request documentation evidencing the existence of a leak or any other problem that may have resulted in an inequitable charge. (b) u : r (1) Single-family/duplex Effective for all billings on or after March 3, 2010: $9.43 per thousand gallons of average water consumption for the billing periods January through April of the years 2007, 2008, and 2009. Any user with an average water consumption of less than a thousand gallons per month shall pay $18.86 as the.bimonthly sewer charge. Effective for all billings on or after January 1, 2011: $10.75 per thousand gallons of average water consumption for the billing periods January through April of the years 2008, 2009, and 2010. The three year average consumptions will be recalculated on January 1, 2011. Any user with an average water consumption of less than a thousand gallons per month shall pay $21.50 as the bimonthly sewer charge. Effective for all billings on or after January 1, 2012: $12.25 per thousand gallons of average water consumption for the billing periods January through April of the years 2009, 2010,. end 2011. The three year average consumptions will be recalculated on January 1, 2012. Any user with an average water consumption of less than a thousand gallons per month shall pay $24.50 as the bimonthly sewer charge. (2) Multifamily residential Effective for all billings on or after March 3, 2010: $8.81 per thousand gallons of water consumption for the current billing period. Effective for all billings on or after January 1, 2011: $10.05 per thousand gallons of water consumption for the current billing period. Effective for all billings on oz• after January 1, 2012: $11.45 per thousand gallons of water consumption for the current billing period. (3) Restaurant, caterers, Effective for all billings on or after March 3, supermarkets, bakeries and 2010: other commercial food processing and food -related $25.08 per thousand gallons of water commercial consumption for the current billing period. Effective for. all billings on or after January 1, 2011: $28.59 per thousand gallons of water consumption for the current billing period. Effective for all billings on or after January 1, 2012: $32.59 per thousand gallons of water consumption for the current billing period. (4) Moderate strength Effective for all billings on or after March 3, cozi�inercial, includizig 201C: manufacturing, hotels with restaurants and hospitals $1_6.91 per thousand gallons of water consumption for the current billing period. Effective for all billings on or after January 1, (5) Light strength commercial including office - warehouse, office buildings, cocktail lounges, auto - related, carwash, Laundromats, convalescent homes and hotels without restaurants 2011: $19.27 per thousand gallons of water consumption for the current billing period. Effective for all billings on or after January 1, 2012: $21.97 per thousand gallons of water consumption for the current billing period. Effective for all billings on or after March 3, 2010: $10.41 per thousand gallons of water consumption for the current billing period. Effective for all billings on or after January 1, 2011: $11.87 per thousand gallons of water consumption for the current billing period. Following a second consecutive January, February, March, and April, the rate will be further adjusted according to the demonstrated water usage for the total eight months on January i following the second consecutive period. Section 4. The City Council finds that the rates adopted by this ordinance are not discriminatory or excessive and are intended to provide sufficient revenue to operate the sewer enterprise pursuant to the Government Code. Section 5. If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this Ordinance. The Council hereby declares that it would have adopted the Ordinance and each section, subsection, sentence, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid. Section 6. The City Council finds that the adoption and implementation of this Ordinance are exempt from the provisions of the California Environmental Quality Act because this project has no possibility of having any significant effect upon the environment (pursuant to CEQA Guidelines section 15061). Section 7.
